Category of the „culpa lata“ in the Context of criminal-law Development

Abstract:

Má diplomová práce pojednává o pojmu hrubá nedbalost, který se před účinností nového trestního zákoníku v platné trestněprávní úpravě na našem území nikdy nevyskytoval. V této práci si kladu za cíl nejprve uvést pojem hrubá nedbalost do širšího kontextu pojmů trestního práva, tj. popsat koncepci subjektivní trestní odpovědnosti a s ní související pojmy, se kterými bude dále pracováno, zejména pojmy trestný čin a znaky skutkové podstaty trestného činu, z nichž pro tuto práci nejdůležitější je subjektivní stránka trestného činu reprezentovaná zaviněním. Dále bude detailněji rozebrán pojem „nedbalost“ z hlediska vývoje pohledu na tento institut, včetně současných definic nedbalosti zahraničních autorů. Budou vysvětleny významové roviny pojmu hrubá nedbalost, a ty pak srovnány s vybranými zahraničními trestními úpravami. Následovat bude exkurz vývojem zákonných úprav na našem území od roku 1852 až do současnosti. Hrubé nedbalosti ve smyslu nové úpravy bude věnována největší pozornost, a to z hlediska důvodů jejího vzniku, interpretace, dokazování, popsány budou skutkové podstaty, u kterých je vyžadována, také s přihlédnutím k časové působnosti nové úpravy (z. 40/2009) ve vztahu k dřívější (z. 140/1961). Práce bude uzavřena zhodnocením přínosu hrubé nedbalosti pro trestní právo a doporučením de lege ferenda.

Abstract:

My thesis discusses the concept of culpa lata, that, before the new Penal Code in valid concept of criminal responsibility , never even appeared in our region. The aim of this thesis is firstly to put the term culpa lata in a broader context of criminal law, ie. to describe the subjective concept of criminal responsibility and related concepts with which I will continue to work. , especially notions concept of crime and characteristics of the crime of which the indictable offence is the most subjective aspect of a crime and also the most importnat for this thesis. Furthermore the term negligence will be analyzed from instituional point of view including the current definitions of negligence by foreign authors. The levels of meanings of term culpa lata will be explained in detail and then compared with slected foreing criminal modifications. I will continue with describing the history of law development in our country from 1852 to present day. Culpa lata, within the meaning of the new modification of criminal law will be given the most attention due to reasons of its creation, interpretation, evidence, facts. The merit will be described where needed, also taking into account the temporal scope of the new modification (law 40/2009) in relation to the former (law 140/1961). My thesis will be concluded by evaluating the contribution to culpa lata for the criminal law and by recommendations on legal aspects.
