Advocacy and justice in England in Victorian era

Abstract:

Tato diplomová práce je shrnutím historicky významného vývoje advokacie a justice ve viktoriánském období. Vláda královny Viktorie s sebou přinesla mnoho změn a převratů, z nichž mnohé přetrvaly do dnešní doby. Cílem této práce je přiblížit strukturu tohoto období a zejména vývoj právní úpravy. Historie justice v Anglii se začíná formovat již v angloamerickém království, kdy platilo právo zejména obyčejové a v řízení před soudy se používaly jako důkaz ordály. Je zde již ale snaha právo kodifikovat. V období normanské Anglie je pokračováno ve změnách soudnictví, a to zejména za vlády Jindřicha II. K důležité reformě soudní organizace potom dochází za stavovské monarchie, kdy byla především zavedena instituce smírčích soudů. Pro Anglii bylo historicky příznačné velké množství soudů, což se postupem doby zredukovalo na rozdělení vyšších a nižších soudů a přetrvalo prakticky až dodnes. Průlom v advokacii se v Anglii začíná formovat ve 13. století. Počátkem 14. století začíná fungovat systém praktického vzdělávání anglických právníků. Začínají se zakládat inns - právnické koleje typické pro anglickou advokacii. Vývoj právnických profesí pokračuje v 16. století, kdy postavení právníků narůstá na významu. Za doby vlády Viktorie se Anglie stala světovou velmocí, vývoj justice a advokacie s sebou přinesla spoustu změn a významné sjednocení systému. Převrat ve zjednodušení justice přinesla reforma Judicature Act (1873 - 1875) jako první krok ke sjednocení a modernizaci soudů. Ve viktoriánském období se dále vyvíjí advokacie a dochází k jejímu dalšímu ukotvení v právním systému. Její dvě hlavní části - barristři a solicitoři, jsou dodnes nedílnou součástí práva Velké Británie. Rozdíl mezi anglickým a kontinentálním právem je značný. Anglické právo není založeno na používání zákona jako prvotního pramene práva tak, jak je tomu u práva kontinentálního. Primárním je používání práva soudcovského (common law a equity) a precedentů. I v Anglii ovšem platí řada zákonů, ať již historicky zachovaných či současných. Soudní precedenty tedy nejsou výlučným pramenem práva, ovšem pro právní systém mají podstatný význam. Anglie si své specifické postavení justice a advokacie zachovala až do dnešní doby. Je kladen důraz na historický vývoj a zachování hierarchie justice. V advokacii jsou dodnes důležité instituce The Bar Council a The Law Society. Právní systém je historicky značně významný a v rámci Evropy velice charakteristický. Cílem této práce bylo vytvořit ucelený přehled vývoje právní úpravy od doby průlomových změn viktoriánského období, kdy takovéto shrnutí by mohlo být nejen zajímavé, ale i přínosné pro rozšíření přehledu v další spolupráci s Velkou Británií.

Abstract:

This thesis summarizes historically significant advocacy and justice developments in the Victorian period. Queen Victoria's government has brought many changes and turns, many of which have survived to these days. The aim of this work is to explain the structure of this period and especially the development of legislation. The history of justice in England began to form in the Anglo-American kingdom, when the customary law was in effect, and in court proceedings ordeals were used as evidence. But there was already an effort to codify the law. During the Norman England period, changes in the judiciary continued, especially during the reign of Henry II. An important reform of the judiciary took place in the Estate Monarchy, where the institution of the magistrates' court was introduced. A large number of courts were historically characteristic for England. It has over time been reduced to the division into higher and lower courts, which has remained practically up to now. The advocacy breakthrough in England started to be formed in the 13th century. At the beginning of the 14th century, a system of practical training of English lawyers was established. Inns - lawyers' houses typical for English advocacy were starting to be founded. The development of legal professions continued in the 16th century, when the position of lawyers was growing in importance. During the Victorian era, England became a world power, the development of justice and advocacy brought a number of changes and a significant unification of the system. The Judicature Acts (1873 - 1875) were an important reform, the first step towards the unification and modernization of the judiciary. In the Victorian period, advocacy continued to develop and was further anchored in the legal system. Its two main parts - barristers and solicitors - are still an integral part of UK law system. The difference between English and continental law is considerable. English law is not based on the code of law as the primary source of law, as is the case with continental law. Primary law is the use of common law and equity, and precedents. But even in England, there are a number of acts of law, whether historically preserved or contemporary. Hence, judicial precedents are not an exclusive source of law, but are essential to the legal system. England has maintained its specific position of justice and advocacy until today. The emphasis lies on historical development and preservation of the justice hierarchy. The Bar Council and The Law Society are still important in advocacy. The legal system is historically very important and very characteristic within Europe. The aim of this work was to create a comprehensive overview of legislation development since the breakthrough changes of the Victorian period, when such a summary could not only be interesting, but also beneficial for expanding the overview in further cooperation with Great Britain.
