Licenses for using musical works on streaming platforms

Abstract:

V dnešní době využívá služby hudebních streamovacích platforem, jako je Spotify, SoundCloud atd., přibližně každý pátý člověk, Tímto způsobem má přístup k hudbě kdykoliv a kdekoliv. Toto vše je legální díky pramenů práv upravující užití autorských děl na internetu, ale s pevně daným zákonem se nabízí otázka, zda hudební streamovací platformy mohou upravovat podmínky v jimi uzavřenými licenčními smlouvami. Tato práce, pomocí osobních rozhovorů a emailové komunikace, poukazuje na to, že licence užívány hudebními streamovacími platformami mají své odlišnosti. I když jsou náležitosti licenční smlouvy upravovány zákonem, je zde stále prostor pro vlastní úpravy, které jsou v souladu s cílem každé hudební streamovací platformy. Může se jednat o větší flexibilitu s užíváním díla nebo jen o typ licenční smlouvy. Tato práce objasňuje, za jakých podmínek je možné oprávněně užít hudební díla na streamovacích platformách a jak se vybrané streamovací platformy liší, pokud jde o uzavírané licenční smlouvy a ujednání v nich obsažená.

Abstract:

Nowadays, about one in five people use music streaming platforms such as Spotify, SoundCloud, etc., thus having access to music anytime, anywhere. This is all legal thanks to the copyright laws governing the use of copyright works on the Internet, but with the law firmly established, the question arises as to whether music streaming platforms can modify the terms in their licensing agreements. This paper, through personal interviews and email communication, highlights that the licenses used by music streaming platforms have their differences. Although the elements of the license agreement are regulated by law, there is still room for custom modifications that are in line with the goal of each music streaming platform. This may be more flexibility with the use of each musical work or just the type of licence agreement used. This paper explains under which conditions it is possible to lawfully use musical works on streaming platforms and how selected streaming platforms differ in terms of the licensing agreements they enter into and the provisions contained therein.
