Abstract:

Diplomová práce na téma Majetku obcí v právní úpravě, vnitřních předpisech a judikatuře provádí rozbor stávající právní úpravy týkající se majetku obce, a to s přihlédnutím k aktuální judikatuře a s poukazem na vnitřní předpisy obcí v dané oblasti. Pozornost je věnována zejména základním aspektům přímého výkonu vlastnických a jiných majetkových práv obce. Práce je rozdělena celkem do pěti částí. V první části (obecné vymezení majetku obce) je definováno ústavněprávní a zákonné postavení obce, jsou zde vymezeny základní pojmy jako vlastnictví a majetek, a to ve vazbě na majetek obce a jeho funkci a významu ve veřejné správě. Na druhou část, ve které jsou popsány základní způsoby nabývání majetku obcemi, navazuje část třetí, popisující základní principy a povinnosti obce při hospodaření s jejich majetkem. Části čtvrtá je věnována samotnému přímému výkonu vlastnických práv. Jsou zde vymezeny jednotlivé orgány obce podílející se na tomto výkonu práv včetně jejich pravomocí a specifikovány formy nakládání s majetkem obce. Podrobněji je pak rozebrána problematika záměru o dispozici s majetkem obce, a to zejména z pohledu praktických problémů a soudní judikatury. V poslední části je zmíněna problematika kontroly a odpovědnosti jako nezbytné součásti procesu hospodaření a nakládání s majetkem obce. V závěru práce je provedeno shrnutí dané problematiky a nastíněny možnosti změn právní úpravy majetku obcí de lege ferenda.

Abstract:

The dissertation on the topic of municipal property in legislation, internal regulation, and case law carries out an analysis of existing legislation concerning municipal property, and takes into account current case law, with reference to internal regulations of municipalities in the given area. Particular attention is devoted to the basic aspects of direct exercise of ownership and property rights of the municipality. The thesis is divided into five parts. In the first part (a general definition of municipal property), the constitutional and legal status of a municipality is defined, as well as basic concepts such as ownership and property in connection with municipal property and its function and significance in public administration. The second part, which describes the basic ways of acquiring property by municipalities, is followed by the third part, describing the basic principles and obligations of the municipality in managing its property. The fourth part is devoted to the direct exercise of ownership rights in itself. The individual municipal authorities involved in the exercise of these rights are identified, including their powers, and the forms of disposition of municipal property are specified. A more detailed analysis of the issue of municipal property disposal follows, in particular from the point of view of practical problems and case law. The last part notes the issue of controlling and responsibility as necessary components of the management and disposition of municipality property. The conclusion of the dissertation includes a summary of the given issues and the possibilities of changes in municipal property legislation de lege ferenda.
