VAT frauds

Abstract:

Předmětem této bakalářské práce je problematika podvodu na DPH v České republice popsaná v teoretické i praktické rovině. Teoretická část vysvětluje rozdíl mezi trestněprávní a daňovou definicí podvodu, vymezuje základní judikaturu k podvodu na DPH a shrnuje základní typy podvodů i dostupná opatření k boji proti nim. V praktické části tato práce ukazuje modely řetězových podvodů v různých komoditách, přičemž také popisuje hlavní znaky a úlohu jednotlivých článků podvodného řetězce. Současně je zde stručně popsán základní postup správce daně v daňovém řízení vedeném u subjektu, který se účastnil podvodu na DPH.

Abstract:

The subject of this bachelor's thesis is the issue of VAT fraud in the Czech Republic, described both theoretically and practically. The theoretical part explains the difference between the criminal and tax definitions of fraud, defines the basic jurisprudence on VAT fraud and summarizes the basic types of frauds and available measures to combat them. In the practical part, this work shows the models of chain fraud in various commodities, while also describing the main features and the role of individual links in the fraudulent chain. At the same time, here is a brief description of the basic procedure of the tax administrator in tax proceedings conducted with an entity that participated in VAT fraud.
