Assessment of system of controls of risk of undeclared work at local level

Abstract:

Tato práce se zabývá vnímáním systému kontrol nelegálního zaměstnávání na lokální úrovni inspektory, kteří tyto kontroly provádějí. Na základě zvolených kategorií stanovených ve sledovaných rovinách: legislativní, správy a implementace kontrol, situací do kterých se inspektoři dostávají a jejich důsledky, je práce zaměřena na zjištění, v čem je zavedený systém těchto kontrol vyhovující, či ne. Pojmy nelegální zaměstnávání, kontroly a vnímání jsou zpracovány v teoretické části této práce. Teorie byla základem pro empirickou část, tj. pro rozhovory s vybranými respondenty (inspektory), analýzu a intepretaci jejich odpovědí. Na základě zjištěného vnímání zavedeného systému inspektory jsou stanovena doporučení pro kontrolní úřad, jejichž implementace by mohla nastavit systém tak, aby došlo ke sladění zavedených skutečností (vycházejících z teoretických poznatků) s praktickými zkušenostmi inspektorů (respondentů) kontrolujících toto zaměstnávání. Předmětný systém je vnímán dvojím způsobem. Inspektoři vnímají nelegální zaměstnávání jako negativní aspekt (stejně jako systém). Pozitivně vnímají zaměření kontrol systému a určení kontroly jako nástroje eliminace tohoto zaměstnávání. Negativně však vnímají právní předpisy a metodiky, kterými se kontroly řídí. To se pak zásadně negativně promítá do situací, procesu a jednotlivých fází kontrol.

Abstract:

This work engages in comprehension of a control system of illegal employment on local levels, by Inspectors, who conduct these controls. On grounds of selected categories defined in monitory levels: legislative, administrative and implementation of controls, the situations the Inspectors get in to and their consequences, their work specializes in findings, if the established system of these controls is satisfactory or not. Notions "illegal employment", control and perception are worked on in theoretical parts of this work. On grounds of this theory is conducted empirical part, Interviews with selected Inspectors, analysis and interpretation of their answers. On bases of these findings - perception of established systems by Inspectors, recommendations are set up for Department of Control. The implementation of these recommendations could set up a system which should harmonized the established facts (coming out from theoretical experiences) with practical experiences, obtain by Inspectors controlling these employments. This subject system is perceived two different ways. The Inspectors perceived illegal employment as a negative aspect (as well as system). They positively perceive zero-on controls and determination of these controls as a tool to eliminate such employments. The negative parts of these controls are the legal rules and methods which direct these controls. They negatively influence the situation, the proces and the individual phases of controls.
