Tax offences

Abstract:

The base of bachelor work is Tax offences. The problema of tax offences everytime was comprehensive, and nowadays i tis the same. I tis not so explored, but mainly explained in such ins and outs such as others themes in criminal subject. So many concepts related with this setpoint is not qualified so exactly. Many tax experts, investigators have been trying to find exact definition. But there are new facts which come up and so that there are still new questions. The aim of the work was to find conexions and draw on the problema and terminology of criminal activity in tax area. At the begining we will focuse on characteristic of tax constitution. We will continue wit the characteristic of criminal activity. We will define its definition, the way how wrongdoer causes criminal activity. After the teoretical definition of single concepts, we will go og to analytical part of the work. We will appoint tax offences, their meritses, which define criminal base of the act. We will introduce the concrete cases of criminal tax activity from the prax. At the end we will clarify which means can help to detect criminal factum.

Abstract:

Témou bakalárskej práce sú Trestné činy daňové. Problematika daňových trestných činov vždy bola, a aj v súčasnej dobe je veľmi obsiahla. Nie je preskúmaná, ale hlavne vysvetlená do takých podrobností ako iné témy v trestnej tematike. Veľmi veľa pojmov súvisiacich s danou témou nie je presne a konkrétne vymedzených. O presné zadefinovanie sa pokúšalo už mnoho daňových expertov, vyšetrovateľov, avšak vždy vyjdú na povrch nové skutočnosti, a tým pádom vznikajú stále nové a nové otázky. Cieľom práce bolo nájsť súvislosti a priblížiť problematiku a terminológiu trestnej činnosti v daňovej oblasti. Na začiatku sa zameriame na charakteristiku daňovej sústavy. Pokračovať budeme s charakteristikou trestnej činnosti. Zadefinujeme si jej vymedzenie, akým spôsobom sa páchateľ dopúšťa trestného konania. Po teoretickom zadefinovaní jednotlivých pojmov, prejdeme na analytickú časť práce. Tu si vymenujeme jednotlivé trestné činy daňové, ich skutkové podstaty, ktoré určujú samotnú trestnosť činu. Predstavíme si niektoré konkrétne prípady konania daňovej trestnej činnosti z praxe. V závere si objasníme akými spôsobmi je možné odhaliť takéto trestné konanie.
