Leniency Programme in Czech and European Competition Law

Abstract:

Cílem práce je poskytnout srovnávací analýzu evropského a českého programu shovívavosti, jako nástroje sloužícího k odhalování kartelů. Součástí práce bude nejen pohled na obecné principy, na kterých musí každý efektivní program stát, ale také na konkrétní podmínky, za kterých je poskytována imunita či snížení pokuty pro soutěžitele v rámci činnosti Komise EU a jak tyto podmínky prověřila aplikační praxe. Dále bude zhodnoceno, jak dalece byl evropský program předlohou pro program český, v čem spočívají případné rozdíly mezi programy a jaké jsou důvody těchto rozdílů. Pro lepší srovnání bude nabídnuta analýza maďarského a britského programu shovívavosti se zaměřením na rozdíly od českého případně evropského programu. Pro efektivitu programu shovívavosti hraje důležitou roli nejen samotná podoba programu, ale také jaké je institucionální nastavení prostředí, ve kterém působí. Proto bude v práci řešen vztah programu shovívavosti a soukromoprávního vymáhání náhrady škod, dále vztah programu shovívavosti a v soutěžním právu nově využívaného institutu narovnání a také bude zmíněno, co se bude muset vzhledem k programu shovívavosti změnit s novou úpravou trestního zákona.

Abstract:

The goal of this thesis is to provide a comparative analysis of an European and Czech Leniency Programme. The Leniency Programme serves as an effective tool in the fight against cartel agreements. The thesis will define not only general principles that have to be fulfilled for effective functioning of the programme, but also the particular conditions, under which immunity and reduction of fines is provided by European Commission and the applications of the programme in the Commissions decisions. The question, whether European programme was a model for the Czech one, will be answered, if so, what the differences of those programmes are and what is a reason for them. For a broader picture there will be an analysis of a Hungarian and British Leniency Programme with a focus on differences between them and the European and Czech Programmes. The efficiency of the Leniency Program is not determined only by its own design, but also depends on other institutional conditions, because of this the relationship of Leniency and Action for Damages needs to be solved and also the relationship of Leniency and in competition law newly applied institution of settlement needs to be clarified. The Czech Republic and its antitrust authority will also have to deal soon with new criminal code and the relationship the Leniency and a criminal persecution of cartelists.
