Abstract:

Diplomová práce se zabývá omezením svéprávnosti a podpůrnými opatřeními pro fyzické osoby. Skládá se z teoretické a výzkumné části. Je rozdělená do 7 kapitol. První kapitola se zabývá vymezením definice svéprávnosti a právní osobnosti. Druhá kapitola se zabývá historickým kontextem k tomuto tématu, třetí opatrovnictvím. Čtvrtá kapitola se podrobně věnuje svéprávnosti. Pátá kapitola se vymezuje k propojení sociální práce a veřejného opatrovnictví. Stěžejní je šestá kapitola, která definuje konkrétní podpůrná opatření. V rámci sedmé kapitoly je zařazen výzkum. Výzkum je veden kvalitativně. Cílem práce je prozkoumat zkušenost veřejných opatrovníků se změnou zákona zabývající se omezením svéprávnosti a zavedením institutu podpůrných opatření a v neposlední řadě také jejich zkušenosti s implementací těchto institutů do praxe. Důležitý je tedy pohled veřejného opatrovníka.

Abstract:

The thesis deals with limitation of authenticity and support measures for individuals. It consists of theoretical and application part. It is divided into 7 chapters. The first chapter deals with the definition of the legal personality. The second chapter deals with the historical context of this topic, the third guardianship. The fourth chapter is devoted in detail to legal capacity. The fifth chapter defines the connection between social work and public custody. The sixth chapter defines specific support measures. Research is included in the seventh chapter. The research is conducted qualitatively. The aim of this work is to explore the experience of public guardians with the amendment of the law dealing with the limitation of their legal capacity and the introduction of the institute of supportive measures and last but not least their experience with the implementation of these institutes into practice. The public guardian's view is therefore important.
