Abstract:
Tato diplomová práce se zabývá účelem trestání. Ten je přiblížen zejména prostřednictvím klasifikace funkcí, které má trest plnit a prostřednictvím teorií, kterými se trestání ospravedlňuje (retributivismus a konsekvencialismus). Hlavním cílem práce je podrobně popsat tyto teorie, jejich jednotlivé podoby, zhodnotit jejich argumenty a zabývat se problémy, které mohou vyvolávat. Práce se též věnuje …more

This diploma thesis addresses the purpose of punishment. This is approached mainly through the classification of the functions that punishment is expected to fulfil and through the theories that justify punishment (i.e., retributivism and consequentialism).
