Restorative justice and its elements in criminal law

Abstract:

Ve své práci se snažím vysvětlit, co to vlastně znamená restorativní justice, jak funguje a působí, které principy ji ovládají a jak ovlivňuje justiční systémy, zejména justiční systém České republiky. Uplatňování principů a metod restorativní justice přináší řešení některých problémů s kriminalitou, se kterými se potýká nejen Česká republika, ale i většina států západní Evropy a některé státy mimoevropské. V dlouhodobé koncepci vývoje se jedná o řešení nárustu kriminality a s tím spojenou nedostatečnou kapacitu věznic a přetížení soudů a orgánů činných v trestním řízení. Svou práci jsem zaměřila především obecně a snažila jsem se vytvořit ucelený přehled o principu restorativní justice.

Abstract:

In my work I try to explain, what is the meaning of the restorative justice, how does it work which principles regulate it and how the restorative justice influence judicial systems especially judicial system of the Czech republic. Applying principles and methods of alternative justice brings solution of some problems with criminality in the Czech Republic and other states of the Western Europe and also some noneuropean states. In the long-term conception of progress it is about solving the criminal increase solution leading to insufficient capacity of prisons, surcharge of courts and other authorities engaged in the prosecution. I directed this work generally and I try to create a compact outline about the principle of the restorative justice.
