Lease and Tenure (general concept, key differences)

Abstract:

Hlavní téma mé bakalářské práce je nájem a pacht. Věnuji se jak historickému pojetí těchto pojmů, tak jejich současnému pojetí a funkci. Oba termíny jsem dopodrobna prostudovala, popsala jejich náplň, funkci a vysvětlila aktuální platnou úpravu. Cílem mé práce je tuto problematiku srozumitelně přiblížit i laické veřejnosti, která nemá v právním prostředí dostatečný přehled a může se jí zdát právní úprava nesrozumitelná. Dalších cílem je také jejich srovnání a zhodnocení funkčnosti těchto institutů v praxi. Po popisu obsahu pojmů nájem a pacht se věnuji jejich rozdílům. Přibližuji, co přineslo s platností Nového občanského zákoníku opětovné zavedení pojmu pacht a jaké rozdíly jsou mezi těmito dvěma instituty nastoleny, přesto, že dlouhá léta byly upraveny společnými ustanoveními. V praktické části práce předkládám návrhy řešení těch problémů, které se mi jevily nepraktické, či zákonem nedostatečně upravené a přikládám výsledek svého průzkumu z instituce majetkového odboru městského úřadu, kde s touto problematikou ve velké míře pracují.

Abstract:

The main topic of my bachelor thesis is tenure and lease. I discuss their historical concept as well as their function in the present. I have studied both terms thoroughly and described their function and current regulation. My main objective is to describe this topic in a matter that's understandable to the general public as it might come across as difficult and hard to understand without certain level of legal knowledge. My next focus was to compare these two terms and analyse their functionality in common practice. I have first described the principles of tenure and lease and then compared their differences. Even though tenure and lease used to be a part of the same regulation for many years, tenure was only recently re-established in the new civil code. I am focusing on it's differences compare to lease. In the practical part of my thesis, I suggest solutions for issues I found in this legislation. These issues were caused by legslations's inpracticality as well as a lack of regulation. I present the results of a survey I completed in cooperation with the city council's property division as this is their area of expertise.
