Superficies Solo Cedit Principle in the Cadastre of Real Estate

Abstract:

Tato bakalářská práce se zabývá projevem zásady superficies solo cedit v katastru nemovitostí. V úvodní části je stručný historický nástin této zásady v českém právu, pak následuje rozbor, jak se tato zásada projevila v katastru nemovitostí. V dalších kapitolách jsou popsány jednotlivé výjimky z této zásady se stručným popisem listin pro jejich zápis do katastru. Součástí práce jsou částečné výpisy z listů vlastnictví s pozměněnými údaji. Závěr práce je věnován souhrnu shromážděných poznatků s návrhy de lege ferenda.

Abstract:

This bachelor thesis deals with the manifestation of the principle of superficies solo cedit in the cadastre. In the introductory part is a brief historical outline of this principle in the Czech law, then followed by an analysis of how this principle manifested itself in the real estate cadastre. In other chapters are described the various exceptions to this principle with a brief description of documents for their registration in the cadastre. Part of the work are partial extracts from the leaves ownership with the modified data. The conclusion of the thesis is devoted to the summary of the collected findings with proposals de lege ferenda.
