Tato diplomová práce pojednává o problematice nabývání podílu v pozůstalostním řízením, případně o způsobech, jak (a pokud je to vůbec možné) zajistit přechod podílu mimo pozůstalostní řízení. Práce se rovněž zabývá doprovodnými právními instituty a procesy, které do problematiky přechodu podílu v pozůstalostním řízení dále zasahují, například společným jměním manželů či rejstříkovým řízením.
