Translating the Language of the Law: Common Errors in Students’ Translations

Abstract:

Tématem této diplomové práce je překlad právního jazyka. Teoretická část popisuje základní poznatky o právním překladu, ze kterých vychází praktický výzkum založený na analýze chyb ve studentských právních překladech. V první kapitole jsou nejprve stručně představeny vybrané teorie překladu, a to konkrétně ty, jejichž přístupy a metody nacházejí uplatnění i v právním překladu. Druhá teoretická kapitola popisuje povahu anglického právního jazyka – jak charakteristická slova a fráze, tak celkový styl projevu. Srovnává negativní přívlastky, které jsou této odborné mluvě mnohdy připisovány, s tím, jak by měl právní jazyk ideálně vypadat, především v souvislosti s reformou právní angličtiny a hnutím Plain English Campaign. Třetí kapitola se zabývá procesem právního překladu, tedy složitého přenosu právně-lingvistické informace z jedné kultury do druhé, a upozorňuje na důležitost důkladné pojmové analýzy. Kapitola také uvádí na pravou míru mýty o (právním) překladu a vysvětluje, jakým způsobem tyto mylné představy ovlivňují společnost. Poslední teoretická kapitola se zabývá faktory, které ovlivňují kvalitu právních překladů konkrétně v České republice. K těmto faktorům patří odlišnosti mezi kontinentálním a angloamerickým právním systémem, kompetence českých právních překladatelů (a zákony, které jejich kompetence regulují) i charakter českých právních textů. Praktická část nejdříve představuje účastníky výzkumu (studenty a profesionály), výchozí text a použitou metodu hodnocení. Výsledky analýzy jsou následně rozděleny do osmi tematických kategorií obsahujících významové, stylistické i gramatické chyby v překladech. V prvních šesti kategoriích se nacházejí prohřešky plynoucí z typických znaků anglického právního jazyka (například z nadužívání slovesa shall či z faktu, že mnoho běžných slov mívá v právním kontextu jiný význam), další dvě kategorie poté vysvětlují chyby na úrovni cílového jazyka. Každá kapitola srovnává lepší a horší překlady, uvádí jejich frekvenci a objasňuje, proč jsou některá řešení méně vhodná a z jakých důvodů se překladatelé těchto chyb nejspíše dopustili. Součástí praktické části je vyhodnocení dotazníku, ve kterém profesionálové vysvětlují, v čem dělali na začátku své kariéry nejvíce chyb, jak se naučili se jich vyvarovat, co by poradili méně zkušeným kolegům a jaké zdroje používali u zadaného překladu. Tyto informace mohou spolu s přehledem chyb sloužit jako odrazový můstek všem začátečníkům, kteří by uvítali rady, co je v právním překladu důležité a čemu věnovat zvýšenou pozornost. V závěru práce jsou shrnuty výsledky analýzy. Není překvapením, že náležité právně-lingvistické vzdělání a léta profesních zkušeností jsou těmi nejdůležitějšími předpoklady pro vysoce profesionální právní překlad. Výsledky analýzy nicméně dokazují, že značnou část chyb by studenti mohli eliminovat, kdyby k vyhledávání informací používali lepší zdroje, nepřekládali tak doslovně a věnovali větší pozornost stylistice cílového textu. Přílohy obsahují výchozí text, studentské i profesionální překlady a vyplněné dotazníky.

Abstract:

The present thesis deals with translating the language of the law. The theoretical part focuses on the principles of legal translation, on which the practical analysis further draws, presenting common errors in students’ legal translations. In the first chapter, some of the translation theories are briefly introduced, namely those the approaches and methods of which find their use in legal translation. The second theoretical chapter defines the nature of English legal language – both its characteristic terms and phrases and its style in general. Later on, the negative attributes which are often associated with legalese are compared to the desired qualities of good legal style, especially in the context of Plain English Campaign that fights for clarity and brevity of legal language. In the third chapter, the process of legal translation is examined as a complex process of transferring legal-linguistic information from one culture to another, drawing attention to the importance of a thorough conceptual analysis. Moreover, this chapter clarifies the myths about (legal) translation and explains the way these mistaken beliefs influence the general public. The last theoretical chapter explores the factors which influence the quality of legal translations particularly in the Czech Republic. These factors include the differences between the civil law and the common law legal systems, competences of Czech legal translators (and laws by which they are regulated) and general style of Czech legal texts. In the practical part, the participants of the analysis (students and professionals) are introduced, as well as the source text and the research method. The identified errors, that is, solutions with conceptual inadequacy, stylistic inappropriateness or incorrect grammar and spelling, are divided into eight thematic categories. The first six categories of errors have resulted from the nature of legal language (for instance, from overusing the verb shall or from the fact that many ordinary words have uncommon meanings in legal context). The following two categories list errors that were made on the target-language level. In each of these chapters, worse translations are compared with the better ones and the frequency of the errors is mentioned, too. The reasons for labelling some of them as “less appropriate” are provided and their possible causes are discussed. In addition, outcomes of the questionnaire completed by professional translators are presented, answering why did professionals make errors at the beginning of their career, how did they manage to improve themselves, what would they advise to their less experienced colleagues and what resources did they use when translating the assigned text. These useful tips, along with the overview of common errors, could be appreciated by all beginners seeking advice on what is essential in legal translation and how usual pitfalls can be avoided. The conclusion summarizes the results of the analysis. Not surprisingly, proper legal-linguistic education and years of professional experience are the key aspects for ensuring a high-quality legal translation. Nevertheless, the outcomes of the analysis prove that a significant part of the errors could have been eliminated if the students used better resources for finding information, if they did not translate the source text so literally and if they paid more attention to the stylistics of the target language. Finally, the source text, students’ and professionals’ translations and full versions of the questionnaire are attached in the appendices.
