The European Union as a Human Rights Organization: Member States of the European Union and Their Control in the Area of Human Rights by the European Union

Abstract:

The thesis deals with observance of human rights by member states and with the range of competences of the EU in case of violation of human rights by member states. By the analysis of the primary law, the thesis characterizes progress in this field not only in legislation but also in the whole policy of the EU towards member states in the field of human rights violation. The starting point of the thesis is The article 7 Treaty of the European Union that declares the procedure of the EU when violation of common and fundamental values by member state occurs and sets the Council majority status in the political process. Furthermore, the thesis characterizes two important cases, when the European Union dealt with issue of human rights violation by member states. Based on the comparison, the thesis evaluates the importance as well as the EU competencies and approach towards member states. The thesis also examines individual attitudes of member states and institutions of the EU towards fundamental values, which are the corner stones of the EU. The aim of the thesis is to reveal the answer on how the progress and the present policy of the EU in the field of human rights strengthened its competencies towards member states and which factors contributed to it.

Abstract:

Práca sa zaoberá dodržiavaním ľudských práv členskými štátmi, respektíve rozsahom právomocí Európskej únie voči členským štátom v prípade ich porušovania. Analýzou primárneho práva práca charakterizuje vývoj v tejto oblasti nielen v rámci právneho ukotvenia, ale aj celkovej politiky Európskej únie voči členským štátom v oblasti zamedzenia porušovania ľudských práv. Východiskovým bodom je článok 7 Zmluvy o Európskej únii, ktorý deklaruje postup Európskej únie, ak dôjde k porušeniu spoločných a základných hodnôt členským štátom, a ktorý vymedzuje Rade majoritné postavenie v tomto politickom procese. Práca taktiež charakterizuje dva významné prípady, kedy sa Európska únia zaoberala problematikou porušenia ľudských práv členskými štátmi a na základe ich komparácie vyhodnocuje ich mieru významu a tiež reálne kompetencie a prístup Európskej únie voči členským štátom. Práca taktiež skúma jednotlivé postoje členských štátov a inštitúcií Európskej únie k dodržiavaniu základných hodnôt, na ktorých je Európska únia postavená. Cieľom práce je odpovedať na otázku, ako vývoj a súčasná politika Európskej únie posilnila právomoci Európskej únie v oblasti ľudských práv voči členským štátom a aké faktory k tomu prispeli.
