The Funding, Administration and Enforcement of Claims in International Trade

Abstract:

Anotace Tato bakalářská práce představuje, zejména budoucím podnikatelům, instituty a instrumenty zajišťující prevenci vzniku nedobytných pohledávek, možnosti správy a vymáhání pohledávek, jejichž efektivita a výsledky jsou prověřeny několikaletým používáním a zlepšováním v praxi nadnárodního koncernu. Práce dále přibližuje nutnost správy pohledávek. Agendu správy a vymáhání pohledávek začleňuje do práv a povinností vyplývajících z obchodněprávních vztahů v tuzemsku i v mezinárodním obchodě. Problematika pohledávek po splatnosti je problematikou, která významným způsobem zatěžuje všechny podnikatelské subjekty a pro řadu z nich může být i likvidační. Práce se tak snaží pozitivně upozornit na tyto negativní jevy a nabízí orientaci v široké a poměrně složité právní problematice pohledávek a jejich vymáhání. Podnikatelským subjektům by tato práce mohla být jakým si návodem, jak zajistit, aby efektivním způsobem řídili riziko vzniku nedobytných pohledávek při jejich podnikatelské činnosti.

Abstract:

Annotation The presented bachelor Thesis introduces, maily to the prospective enterprises, the institutions and instruments providing the inception of irrecoverable claims prevention, the possibilities of claim administration and collection which effectivity and results have been proved by several years of their exercitation and improving in the practice of a multinational concern. The Thesis also explains the necessity of debt administration. The administration agenda and debt collection is contextualized into the rights and obligations resulting from Commercial Law relations within the domestis as well as the international trade systems. The post-maturity claims problems is an issue which significantly burdens all entrepreneurial subjects and for many of them can become a liquidating one. The Thesis therefore tries to draw the attention to these negative phenomena and offeres a synopsis of a broad and rather complicated law issue of claims and their recovery. To entrepreneurial subjects, the Thesis could serve as a certain manual for assurance of efficient way of a risk management of uncollectable claims origin during their entrepreneurial ativities.
