Abstract:

Cílem této diplomové práce je podat co možná nejkomplexnější výklad právní problematiky, která souvisí s mateřstvím. Analyzovat současnou právní úpravu a poukázat na nedostatky, které se s tímto tématem pojí. Definice určení mateřství se zdá být naprosto jasnou, matkou dítěte je žena, která jej porodila. Mohou však nastat situace, kdy určení mateřství nebude až tak jasné. S rozvojem medicíny je možné řešit neplodnost ženy pomocí asistované reprodukce. I v tomto případě se mateřství určuje dle zásady, že je matkou ta žena, která dítě porodila, bez ohledu na to, jaký genetický materiál byl použit. S asistovanou reprodukcí souvisí také problematika náhradního mateřství, které je v této práci také věnována kapitola. Problém při určování mateřství nastává v případě nalezení dítěte neznáme totožnosti nebo když matka odloží dítě do baby-boxu. K těmto situacím nemusí vůbec docházet, jelikož je v České republice ženám umožněno utajit v souvislosti s porodem svoji totožnost. Poslední kapitola je zaměřena na trestněprávní aspekty související s mateřstvím. V trestním zákoníku nalezneme rovnou několik trestných činů, kterých se může matka vůči svému dítěti dopustit.

Abstract:

The aim of this thesis is to provide the most comprehensive possible interpretation of the legal issues related to maternity. To analyze the current legal regulation and to point out the shortcomings that are related to this topic. The definition of the determination of maternity seems to be quite clear, the mother of a child is the woman who gave birth to it. However, there may be situations where the determination of maternity is not so clear. With the development of medicine, it is possible to address a woman's infertility through assisted reproduction. Again, maternity is determined according to the principle that the woman who gave birth to the child is the mother, regardless of the genetic material used. Assisted reproduction is also related to the issue of surrogacy, which is also the subject of a chapter in this thesis. The problem of determining maternity arises when a child is found with unknown identity or when the mother abandons the child in a baby-box. These situations may not occur at all, since in the Czech Republic women are allowed to conceal their identity in connection with childbirth. The last chapter focuses on the criminal law aspects related to motherhood. The Criminal Code contains several offences that a mother can commit against her child.
