Agricultural Land Fund in the Legal Context and in the European Context

Abstract:

Předkládaná práce se zabývá problematikou právní úpravy ochrany zemědělského půdního fondu, zejména s ohledem na vývoj v posledních letech. Práce vychází z historického přehledu legislativní ochrany půdy v České republice, evropských státech a vývoji jejich vzájemné spolupráce. Těžiště výzkumu spočívá ve vyvrácení či potvrzení dvou hypotéz uvedených v úvodní kapitole týkající se kvality současné právní úpravy ochrany zemědělského půdního fondu, prostřednictvím její analýzy provedené v České republice, Evropské unii a vybraných evropských státech, včetně komparace jednotlivých úprav daného úseku. Relativně nová politika Evropské unie zaměřená na ochranu půdy je v práci řešena i s ohledem na stávající úpravu v České republice, kde právní rámec má odlišný charakter než zaměření unijních předpisů dané oblasti. V závěru práce je provedeno celkové shrnutí textu s návrhy formou „de lege ferenda“ ve smyslu zajištění vhodnější právní ochrany zemědělského půdního fondu v České republice s ohledem na inspiraci právní úpravou okolních států.

Abstract:

This diploma thesis deals with the legislation of protection of Agricultural Land Resources, particularly with regard to the development in recent years. This work is based on a historical survey of soil protection legislation in the Czech Republic, European countries and on the development of their cooperation. The focus of research is the confirmation or refutation of the two hypotheses mentioned in the introductory chapter on the quality of the current legislation, protection of Agricultural Land Resources, through the analysis carried out in the Czech Republic, in the European Union and selected European countries, including a comparison of different modifikations in a given section. A relatively new European Union policy aimed at soil protection is dealt at work also with regard to existing regulations in the Czech Republic, whose legal framework differs character from the Union regulations in a given area. There is an overall summary of the text with the proposals in a "de lege ferenda" to the effect of ensuring of a better legal protection of Agricultural Land Resources in the Czech Republic with regard to the inspiration of the surrounding states legislation in the conclusion of the diploma thesis.
