Abstract:

Téma bakalářské práce je Problematika domácího násilí, účinnost právních nástrojů k jeho řešení a předcházení. Práce se rozděluje na dvě části. Jako první definuje pojem domácího násilí, charakterizuje ohroženou a násilnou osobu. Dále se zaměřuje na oběti domácího násilí (ženy, muže, seniory, zdravotně postižené, děti), znaky, formy a následky domácího násilí, citace z právních norem, postupy soudů, státního zastupitelství, policie. V bakalářské práci je také definován profil pachatele, pomoc obětem, možnosti a pravidla komunikace s ohroženou osobou. Druhá část bakalářské práce se zaměřuje na statistická data z oblasti výzkumu Acorusu. Také jsou v ní obsaženy tři podobné konkrétní případy domácího násilí spáchané na ženách. Záměr zkoumání těchto konkrétních případů je poukázat na to, že ačkoli jsou případy podobného scénáře, nemusejí však vždy skončit potrestáním pachatele. Cílem bakalářské práce je poukázat na to, že problém domácího násilí má mnohem větší rozměry, než se domníváme, že je důležité o této problematice mluvit, poskytovat potřebnou osvětu a poukázat na to, že ve spoustě zemí je násilí považováno za tabu či dokonce normální a běžný aspekt partnerského či rodinného života.

Abstract:

The theme of this bachelor thesis is Problems of Domestic Violence, Effect of Legal Instruments as Means of Its Solution and Prevention. The work is divided into two parts. The first part presents a definition of domesctic violence, it describes an endangered and violent person. The work focuses on domestic violence victims (women, men, elderly people, disable people, children), violence attributes, forms and impacts, law, procedures of the court, the state attorney's office and the police. There is also the definition of a perpetrator profile, help provided to victims, possibilities and rules of communication with the them. The second part of the thesis works with statistic data from the Acorus research. Three specific cases are described further – cases of domectic violence commited on women. The aim of these cases examination is to point out the fact that even though all of them are similiar, the offender doesn’t have to be sentenced. The goal of the thesis is to show that domestic violence is much bigger problem than we think and that it is very important to speak about it, provide necessary education and point out that the domestic violence is a tabu or a normal and ordinary aspect of relationships in many countries.
