The Issue of Drugs from the Perspective of Criminal Law

Abstract:

Tato práce analyzuje problematiku drog a drogové trestné činnosti z mého pohledu. Práce obsahuje celkem čtyři kapitoly. V první kapitole je podrobně popsáno rozdělení drog, jejich charakteristika a účinky na jednotlivce, který drogy užívá. Kapitola přesně popisuje jednotlivé druhy drog včetně jejich účinků a vlivu na lidský organismus a psychiku. Ve druhé kapitole se zabývám historií právní úpravy drogových trestních činů. Snažím se zde analyzovat trestní zákoník č.140/1961 Sb. platný od roku 1961 s dopadem na drogovou problematiku. Ve třetí kapitole porovnávám současný trestní zákoník platný od 1. 1. 2010 v kontextu se zákoníkem, který byl v platnosti 49 let. Ve čtvrté kapitole se snažím zmapovat nejen českou, ale i světovou drogovou scénu. Zabývám se zde nejen historií, ale i vývojem drogové scény. Zajímavý je i pohled z hlediska mezinárodní spolupráce.

Abstract:

This work analyzes the problem of drugs and drugs criminal activity from my point of view. The work contains four chapters. The first chapter describes the dividing of drugs, their characteristics and impacts on the person who takes drugs. The chapter describes exactly single types of drugs , their operations and influence on human organism and psychics. The second chapter I deal with the history of legal regulations of drug crimes. I try to analyze the criminal code number 140/1961 Sb. Valid since 1961 with the impact to the drug problem. In the third chapter I compare the present criminal code valid since 1.1.2010 in the context with the code which was valid for 49 years. In the fourth chapter I try to chart not only the Czech but also the world drug scene. I deal not only with the history but also with the development of the drug scene. The viewpoint of the international coopertaion is also interesting
