Referendum as a tool of direct democracy - a comparative case study for the Slovak Republic

Abstract:

Referendum is referred as a tool of direct democracy created for citizens, through which they can participate directly or enter easier into political power. Comes from the democracy, that was created in ancient Greece, where the first foundations of civil laws, the establishment of the constitution and the first political institutions were laid. Many factors influenced the formation of democracy over several centuries up to the form that is used nowadays. Main focus of this dissertation is to define the issue of the effectiveness of the referendum in the Slovak Republic, because of the nine referendums held so far, only one had a valid result. The first part of dissertation is focused on the theory of democracy and referendums with their importaint historical landmarks. The second – empirical part tries to find an answer through the analysis of the issues of Slovak referendums to answer the established question whether is the referendum in the Slovak Republic effective enough. For findind the right answer, we chose Switzerland as the best comparative example, because is known as a perfect model of direct democracy in Europe.

Referendum sa označuje ako hlavný nástroj priamej demokracie určený primárne pre ľudí, vďaka ktorému sa môžu priamo podieľať alebo zasahovať do výkonu politickej moci. Vyplýva z demokracie , ktorej vývoj sa datuje už za čias starovekého grécka, kde boli položené prvé základy občianskeho práva, založenie ústavy a prvých politických inštitúcií. Formovanie demokracie počas niekoľkých storočí ovplyvnilo mnoho faktorov až do podoby, ktorá je používaná v našom štáte. Zameranie tejto práce spočíva vo vymedzení problematiky efektívnosti referenda v Slovenskej republike, nakoľko z doposiaľ deviatich uskutočnených referend malo iba jedno platný výsledok. Prvá časť práce sa zameriava na teóriu demokracie a referenda s ich dôležitými historickými medzníkmi. Druhá empirická časť práce sa pokúša nájsť odpoveď prostredníctvom analýzy problematiky doterajších slovenských referend na stanovenú otázku, či je referendum v Slovenskej republike dostatočne efektívne. Pri hľadaní správnej odpovede som si ako komparatívny príklad vybrala Švajčiarsko, ktorý je vzorom priamej demokracie pre ostatné štáty.
