Role of ODIHR Election Observation Missions: A Case Study of Ukraine

Abstract:

Tato případová studie se zaměřuje na roli volebních pozorovatelských misí Úřadu pro demokratické instituce a lidská práva (ÚDILP) OBSE na Ukrajině, účastnickém státu OBSE s tradicí působení volebních pozorovatelů a současnou ambicí stát se členem Evropské unie. Studie na základě závěrečných zpráv volebních pozorovatelských misí ÚDILP z prezidentských voleb v období 1999–2019 determinuje problematické oblasti volebního procesu na Ukrajině, oblasti pozitivně hodnocené, jakož i oblasti, ve kterých došlo v pozorovaném období k pokroku, stagnaci či regresi. Práce také objasňuje, zda byla v pozorovaném období implementována doporučení ÚDILP pro vedení voleb v souladu s mezinárodními demokratickými standardy. Případová studie provedenou analýzou přispívá do debaty o členství Ukrajiny v Evropské unii, které je podmíněno garancí demokracie, právního státu a lidských práv, a tedy i svobodných a spravedlivých demokratických voleb.

Abstract:

This case study focuses on the role of the election observation missions of the OSCE Office for Democratic Institutions and Human Rights (ODIHR) in Ukraine, an OSCE participating state with a tradition of election observation and a current ambition to become a member of the European Union. Based on ODIHR election observation missions' final reports from the presidential elections of 1999–2019, the study identifies problematic areas of the electoral process in Ukraine, areas with positive evaluation, as well as areas of progress, stagnation or regression during the observed period. Furthermore, the analysis clarifies whether recommendations for the conduct of elections in accordance with international democratic standards made by ODIHR were implemented in the observed period. Through the analysis, the case study contributes to the debate on Ukraine's membership in the European Union, which is conditioned by the guarantee of democracy, rule of law and human rights, and therefore also free and fair democratic elections.
