The legal remedies of protection against unfair competition and their impact on behaviour between 2010 and 2016

Abstract:

Bakalářská práce se věnuje problematice právních prostředků ochrany proti nekalé soutěži a jejich vlivu na nekalosoutěžní chování, konkrétně v letech 2010-2016.Práce mapuje historický vývoj úpravy práva proti nekalé soutěži v České, potažmo Československé republice, současnou platnou právní úpravu nekalé soutěže a jednotlivé právní prostředky ochrany před nekalosoutěžním jednáním včetně zhodnocení jejich proměn v průběhu času. Práce dále analyzuje počty a délky sporů ve sledovaném období. Skrze konkrétní judikáty a protokol ze soudního jednání ve věci nekalé soutěže práce přibližuje prostředí a atmosféru soudních řízení ve věcech nekalé soutěže a též poukazuje na praktické využití právních prostředků ochrany proti nekalosoutěžnímu jednání.Cílem bakalářské práce je zhodnocení účinnosti, efektivnosti a dostatečnosti platné právní úpravy a právních prostředků v oblasti nekalé soutěže. Vzhledem k získaným údajům lze usoudit, že platná právní úprava prostředků ochrany proti nekalé soutěži je efektivní a má pozitivní vliv na snižování nekalosoutěžních sporů.

Abstract:

This bachelor thesis deals with the legal remedies of protection against unfair competition and their impact on behaviour between 2010 and 2016. The work maps the historical development of unfair competition regulation in the Czech Republic, respectively Czechoslovak Republic current valid legislation of unfair competition and singular legal remedies of protection against the unfair competition behaviour, including the evaluation of their alterations over time. It also analyses the numbers and duration of lawsuits in the period under review and considers their development. Based on specific judicial decisions and protocols from court proceedings that dealt with unfair competition, this work gives insight into the background and atmosphere of court proceedings and points out the practical use of legal remedies of protection against unfair competition behaviour. The objective of this bachelor thesis is to evaluate the efficiency, effectiveness and sufficiency of applicable legislation and legal remedies in the area of unfair competition. In consideration of the obtained data, it can be concluded that the applicable legislation of protection remedies against unfair competition is effective and has a positive impact on the reduction of lawsuits.
