Easements Registrable in the Land Registry

Abstract:

Bakalářská práce se zabývá zápisem staveb do katastru nemovitostí. Hlavním cílem je porovnání zápisů staveb před a po účinnosti nového občanského zákoníku. Nejvýznamněji zápisy staveb do katastru nemovitostí ovlivnilo zavedení superficiální zásady do českého právního řádu, na základě které se stavby stávají součásti pozemku. Tato bakalářská práce se snaží vyhodnotit po teoretické i praktické stránce rozdíly ve způsobech zápisů staveb do katastru nemovitostí. Na příkladech z praxe nastiňuje úskalí novinek v právním řádu a také možná řešení nastalých právních situací.

Abstract:

This bachelor thesis deals with the building's registration into into the Cadastre of Real Estate. The main purpose is to compare building's registrations before and after efficiency of the new Civil code. Building's registrations have been influenced the most since Superficial Principle was introduced into czech legal system. It states that a building is a component of land. Next there is practical and theoretical evaluation of differences in the way of building's registration. On practical examples it presents problems, which can come with new rulles in czech legal systém and it shows possible solutions of those situations.
