Application of the bestseller clause in theatre operation

Abstract:

Bakalářská práce s názvem Aplikace bestsellerové doložky v divadelním provozu se věnuje právní problematice uplatnění přiměřené dodatečné odměny autorovi, v případě, že jeho dílo dosáhne mimořádného komerčního úspěchu. Teoretická část této práce rozebírá právní úpravu bestsellerové doložky v občanském zákoníku a autorském zákoně, věnuje se jejich historii, ale i novelám. Obecně se snaží popsat tuto problematiku u autorů i výkonných umělců. Praktická část se věnuje konkrétním kauzám, u nichž se podařilo i nepodařilo právo na dodatečnou odměnu uplatnit. Cílem této práce je zjistit, jaké má bestsellerová doložka dopady na divadelní praxi, jakým způsobem by se měla využívat a jak by měla být sjednána licenční odměna v případě, že se chce divadlo vyvarovat uplatnění nároku na dodatečnou odměnu.

Abstract:

The bachelor thesis entitled Application of the bestseller clause in theatre operation deals with the legal issue of applying a reasonable additional remuneration to the author in case his/her work achieves extraordinary commercial success. The theoretical part of this thesis analyses the legal regulation of the bestseller clause in the Civil Code and the Copyright Act, focusing on their history and amendments. In general, it tries to describe this issue for authors and performers. The practical part is devoted to specific cases in which the right to additional remuneration was and was not successfully exercised. The aim of this thesis is to identify the implications of the best-seller clause for theatre practice, how it should be used and how royalties should be negotiated if a theatre wishes to avoid claiming additional remuneration.
