Bankruptcy, insolvency and liquidation of a company

Abstract:

Diplomová práce je zaměřena na v současné době velmi diskutovaná témata - insolvenci, úpadek a likvidaci firmy. Nový insolvenční zákon přinesl s účinností od 1.1.2008 do této oblasti podstatné změny, které jsou v diplomové práci popsány a objasněny. Záměrem práce není podat vyčerpávající a detailní výklad tématu, neboť to s ohledem na kapacitu práce a rozsáhlost tématu není reálné. Cílem je komplexní a přehledné zmapování průběhu těchto řízení, ze kterého bude zřejmý rozdíl mezi jednotlivými způsoby řešení úpadku a rozdíl mezi likvidačním způsobem řešení úpadku a mezi likvidací společnosti podle obchodního zákoníku. Tento výklad vyústí ve zhodnocení současného stavu problematiky. V praktické části práce je představena společnost, u níž je úpadek řešen jedním z možných způsobů popsaných v teoretické části a to konkurzem, přičemž jsou hodnoceny příčiny, které společnost do této situace přivedly. V praktické části se také věnuji problematice insolvenční šikany a možnostem, jak se proti tomuto nežádoucímu jevu bránit.

Abstract:

Diploma thesis is focused on currently highly debated issues - insolvency, bankruptcy and liquidation of a company. The new Insolvency Act has brought with effect from January 1st, 2008 substantial changes to this area, which are described and explained in this thesis. The aim of work is not an exhaustive and detailed interpretation of the theme, as with regard to work capacity and size of the topic is not real. The aim is comprehensive and complex mapping of the course of these proceedings, from which will be obvious difference between the ways of dealing with bankruptcy and the difference between liquidation metod of dealing with bankruptcy and liquidation under the Commercial Code. This interpretation results in asses of the current state of the problematic. In the practical part of the thesis is introduced a company, where the bankruptcy is handled by one of the possible ways described in the teoretical part - with bankruptcy order, where the causes are taken into account, that brought company to this situation. In the practical part I also deal with issue of insolvency bullying and possibilities how to prevent this undesirable phenonem.
