Life sentence in the Czech Republic

Anotácia:

Cílem mé bakalářské práce je analyzovat systém doživotního trestu. Dá se říci, že se v této práci zabývám komplexním pohledem na doživotní odsouzení v České republice. V úvodní části jsou vysvětleny základní pojmy trestu a jeho účelu, s důrazem na doživotní variantu trestu. Historické části této formy trestu se věnuji detailně, včetně změn a prolnutí s trestem smrti, který byl v minulosti v naší zemi praktikován. Právní aspekty doživotního odsouzení jsou pak popsány podrobně, zahrnující aktuální právní úpravu a alternativní formy trestu. V následující části je proveden průzkum průběhu výkonu trestu u doživotně odsouzených. Věnuji se také nezbytným právním pojmům a postupům, které souvisí s tímto typem trestu. V odstavci věnovanému charakteristice doživotně odsouzených analyzuji jejich profil a konkrétní případy, s důrazem na typické zločiny vedoucí k uložení tohoto trestu. Snažím se rovněž porozumět psychologickým a sociálním motivacím doživotně odsouzených k jejich činům. Práce se dále zaměřuje na režim ve výkonu trestu na doživotí a poskytuje přehled možností milosti, amnestie a podmínečného propuštění v souvislosti s doživotním trestem v ČR. Závěrečná část shrnuje hlavní poznatky a názory veřejnosti na doživotní odsouzení. Snažím se v této práci poskytnout ucelený pohled na problematiku doživotního trestu v České republice s důrazem na právní, psychologické, sociální a veřejné aspekty.

Abstract:

The aim of my bachelor thesis is to analyze the system of life imprisonment. It can be said that in this thesis I take a comprehensive view of life sentencing in the Czech Republic. In the introductory part, the basic concepts of punishment and its purpose are explained, with an emphasis on the life sentence option. I discuss the historical part of this form of punishment in detail, including the changes and intertwining with the death penalty that was practiced in the past in our country. The legal aspects of life sentencing are then described in detail, including current legislation and alternative forms of punishment. In the following section, an exploration of the course of sentencing of lifers is conducted. I also deal with the necessary legal concepts and procedures associated with this type of sentence. In the section devoted to the characteristics of lifers, I analyze their profile and specific cases, with an emphasis on typical crimes leading to the imposition of this sentence. I also seek to understand the psychological and social motivations of lifers for their actions. The thesis is also focused on the life sentence regime and provides an overview of the possibilities of grace, amnesty, and parole in the context of life sentences in the Czech Republic. The final section summarizes the main findings and public views on life sentencing. In this thesis I try to provide a comprehensive view of the issue of life imprisonment in the Czech Republic with an emphasis on jurist, psychological, social, and public aspects.
