The influence of interest groups upon the process of drafting legislative acts of the EU in the field of genetically modified organisms

Abstract:

Influencing the development of EU legislative acts by various internal and external interest groups is a very common issue in the Union. Lobbyists, non-profit organizations, NGOs and international organizations regularly attempt to achieve the incorporation of their interests into drafted legislative acts. Naturally the interest and influence of these parties varies according to the prominence of the EU policy involved. Genetically modified organisms are however a very controversial topic. Their importance makes them a crossover topic touching upon the Common Agriculture, consumer protection, public health and also environmental policies of the European Union, which accordingly attracts the strong interest of the above-mentioned parties. Therefore the effort to influence the process of drafting EU legislative acts in the field of GMOs is very intense and interesting to study. This thesis thus identifies as its goal to research this topic and study the pressure and influence of interest groups from four categories – environmental protection, consumer protection, agriculture and produce. The indirect influence of an external actor – the WTO, is also considered in the thesis. The thesis researches the influence of interest groups upon the development of the most important binding EU legislation starting from the first EU Directive on the deliberate release of GMOs into the environment adopted in 1990, and concluding with the most recent legislation from 2003. The influence of interest groups is studied in all phases of the legislative process from the drafting of the proposal in the Commission to the connivance of the act in the Council and European Parliament. Tactics and strategies, which were employed by the interests groups, are also analyzed. The main value of this thesis should be, that it not only contains an account of the development of Communitarian legislation on GMOs, but also offers an interesting insight into the process of influencing the drafting of this legislation by interest groups.

Abstract:

Ovplyvňovanie tvorby legislatívnych predpisov v Európskej únií rôznymi internými, ako aj externými aktérmi je veľmi časté. Lobisti, neziskové organizácie, NGOs a medzinárodné organizácie sa pravidelne snažia zabezpečiť inkorporáciu svojich záujmov do pripravovaných legislatívnych predpisov. Samozrejme záujem a vplyv týchto aktérov nie je totožný vo všetkých sférach pôsobenia Európskej únie. Geneticky modifikované organizmy sú však mimoriadne kontroverznou témou. Svojim významom prestupujú hranice rôznych oblastí pôsobenia Európskej únie, pričom zasahujú do spoločnej poľnohospodárskej politiky, ochrany spotrebiteľa, verejného zdravia ako aj do environmentálnej politiky, a adekvátne k tomu aj pútajú pozornosť vyššie zmienených záujmových skupín a aktérov. Snaha o ovplyvňovanie procesu tvorby legislatívnych predpisov EÚ práve v oblasti GMOs je preto veľmi intenzívna a zaujímavá na skúmanie. Táto práca si preto kladie za cieľ ponoriť sa do tejto problematiky a preskúmať tieto tlaky a vplyvy. Práca je špecificky zameraná na skúmanie vplyvu záujmových skupín zo štryoch kategórií - ochrana životného prostredia, ochrana spotrebiteľov, poľnohospodárstvo a produkcia. Braný do úvahy však je aj nepriamy vplyv externého aktéra – WTO. Práca skúma vplyv záujmových skupín na vývoj najdôležitejšej záväznej legislatívy EÚ v oblasti GMO a to počínajúc prvou Smernicou o úmyseľnom vypúšťaní geneticky modifikovaných organizmov do životného prostredia, prijatou v roku 1990, a končiac v súčastnosti najnovšou legislatívou z roku 2003. Skúmaný je vplyv aktérov na všetky fázy legislatívneho procesu od formulácie návrhu v Komisií až po schvaľovanie v Rade a Európskom Parlamente. Analyzované sú takisto taktiky a stretégie, ktoré záujmové skupiny uplatňovali. Hlavným prínosom práce by tak malo byť, že zhŕňa nielen opis vývoja komunitárnej legislatívy v oblasti GMO, ale zároveň prináša zaujímavý pohľad na proces ovplyvňovania tvorby tejto legislatívy záujmovými skupinami.
