The Qualification of Employees and its Improvement

Abstract:

Cílem této práce je přiblížit čtenáři problematiku kvalifikace zaměstnanců a jejího zvyšování, čili problematiku vzdělávání zaměstnanců. Autor se v této práci pokouší podat ucelený pohled na tuto problematiku a otázky související, vycházejíc přitom z dostupné literatury, soudních rozhodnutí a samozřejmě platných právních předpisů. V konečném důsledku by tato práce měla čtenáři umožnit pochopení problematiky vzdělávání zaměstnanců z pohledu současné právní úpravy. Pokud jde o strukturu samotné práce, ta je členěna do devíti kapitol, přičemž kapitola první představuje úvod, kapitola sedmá závěr, kapitola osmá resume a kapitola devátá použité prameny. Kapitola druhá je věnována právním vztahům obecně s jejich následnou konkretizací pro oblast práva pracovního. Kapitola třetí, v podstatě, představuje jakýsi úvod k celé problematice vzdělávání zaměstnanců, neboť v ní autor pojednává obecně o péči o zaměstnance v jejímž rámci je pak vzdělávání zaměstnanců upraveno. Kapitola čtvrtá v sobě zahrnuje nejen všechny formy péče o odborný rozvoj zaměstnanců – tedy jejich zaškolení či zaučení,odbornou praxi absolventů škol, kvalifikaci a její prohlubování a zvyšování, ale i otázky související. Kapitola pátá je věnována dohodě o zvýšení kvalifikace a kapitola šestá se zabývá zvyšováním a prohlubováním kvalifikace zdravotnických pracovníků, které se vyznačuje určitými specifiky oproti obecné úpravě v zákoníku práce.

Abstract:

The aim of this thesis is to inform the reader about the issue of employees’ qualification and possible ways of its accrual, i.e. about the matter of education of employees. The author tries to give a general view of this issue and related questions, using available literature, judicial decisions and, of course, effective legal provisions. In connection with a legal amendment, included in the current code of employment in the enactment no. 262/2006 of the Statute-book, differences between the current and the former legal amendment, which was included in the presently abrogated enactment no. 65/1965 of the Statute-book, the code of employment, were stated where needed. However, the transition to a new legal amendment was not so smooth. The current employment code has been for many reasons criticized from the very beginning, which has lead to changes of certain provisions by the Constitutional court for their divergence with the Constitution of the Czech Republic. The above stated differences or better to say changes can be divided into two groups. Those which reflect changes in the overall conception of the employment code and those which indirectly refer to the tenth part of the employment code (mainly referring to the possibility of avoiding the law on the ‘what-is-not-prohibited-is-allowed’ principle (§ 2 par. 1 to 3) and referring to the connection to a civil code on the delegation principle (§ 4)) can be put in the first group. Changes, which have impact on particular provisions that handle the education of employees, can be placed in the second group. These, in effect, do not bring any crucial inovations, that is why only the EC law implementation or a differentiation between a training and a teach-in and between an extension of qualification and a accrual of qualification and strict distinguishing of these terms are worth mentioning. We can say that the main reason for continuous emendation of the education system of employees is a fact that the education of employees is mostly an employer’s matter since the requirements for skills, competences, experience etc. can and usually differ with every single employer. The code of employment does not lay many obligations concerning this area. It rather represents a minimum amount of emendation leaving the choice of employers’ personal politics to themselves. The liberal conception of the current employment code allows employers to negotiate laws and duties with their employees within larger range. It provides employers with enough space to adjust their laws and duties modyfying the law (naturally with the condition of not interfering, without a legal reason, with laws and justified interests of participants of labour-law relations and at the same time not being at variance with proprieties). As far as structure is concerned, his thesis is divided into nine chapters, chapter one being the introduction, chapter seven being the conclusion, chapter eight the resumé and chapter nine referring to the bibliography. It is not possible to throw a reader straight into the matter of employees’ education leaving basic theoretical knowledge out. Therefore chapter nine is dedicated to legal relations in general with following specialization in the labour law. The author explains the actual term ‘labour’, when the labour law does not refer to the labour itself but to relationships among people which arise from a performance of this kind of the dependent labour. The express necessity of stating the ‘dependent labour’ definition in the code of employment is one of the inovations in the current legal amendment. Then, within labour-law relations this work concentrates on the employment relation as one of the basic labour-law relations. Chapter three, in effect, represents a kind of introduction to the whole issue of education of employees since the author focuses on a general care of employees which also covers the education of employees. fourth and the fifth chapter. Chapter four, called Qualification of employees and its accrual, includes not only all ways of care of a professional development of employees – i.e. a teach-in or a training, training programme for college graduates, a qualification, an extension of qualification and a raise of qualification – but related questions as well, especially the issue of providing labour relieves when studying or working, a few examples to better understand the differentiation between extending a qualification and accruing qualification, as well as fiscal relations of the education of employees or explaining the actual term – qualification. Chapter five is dedicated to the issue of a raise of qualification agreement. It is a bilateral legal operation which is established on a concordant expression of a will of both an employer and an employee, especially with raising a qualification of an employee. Neither accrual of qualification, nor an extension of qualification is connected to clinging a deal like this, but it is in both employer’s and employee’s best interest to conclude a contract since it is a basic tool to agree on mutual laws and duties at the education of employees and to prevent possible disagreements. Therefore the reader will be informed of formal and content side of this agreement and related questions. Chapter six focuses on accruing and extending the qualification of medical workers which, in contrast to the general amendment in the code of employment, is marked out by certain particularities. In the end, this work should help the reader understand the issue of education system of employees from the current amendment point of view.
