Judical decisions in inheritance proceedings

Abstract:

Aim of this thesis was disassembled and individually characterize all judicial decisions, to characterize their nature, divide and move to another team, thus the main chapters of our work and to court decisions in probate proceedings. We tried to maximize the attention paid to the certificate of inheritance, its elements, as well as the effect of the order of inheritance as a way of termination inheritance, and we briefly describe the various stages of the probate proceedings, we approached the end of types and methods of the probate proceedings. We very briefly in this chapter describe the scope and enforceability of judgments. As a last point of our work, we chose a notary, as a judicial commissioner, because the decisions a court commissioner in probate proceedings very closely related and inseparable part of the probate proceedings.

Abstract:

Cieľom bakalárskej práce bolo rozobrať a jednotlivo charakterizovať všetky súdne rozhodnutia, charakterizovať ich podstatu, delenie a tým prejsť k druhej, teda hlavnej kapitole našej práce a to súdnym rozhodnutiam v konaní o dedičstve. Snažili sme sa čo najväčšiu pozornosť venovať osvedčeniu o dedičstve, jeho náležitostiam, účinkom a rovnako aj uzneseniu o dedičstve, ako spôsobom ukončenia dedičského konania, pričom sme stručne opísali aj jednotlivé fázy konania o dedičstve, aby sme priblížili druhy a spôsoby skončenia konania o dedičstve. Veľmi stručne sme v tejto kapitole opísali pôsobnosť a vykonateľnosť súdnych rozhodnutí. Ako posledný bod našej práce sme si zvolili notára, ako súdneho komisára, pretože súdny komisár s rozhodnutiami v konaní o dedičstve veľmi úzko súvisí a je neodmysliteľnou súčasťou konania o dedičstve.
