The Roma minority in the Czech Republic

Abstract:

Problematika romských obyvatel je velmi aktuální, diskutované a mně blízké téma. Proto jsem se rozhodla obsah mé diplomové práce zaměřit na romskou národnostní menšinu. Zájem o tuto minoritu nabývá s postupem času stále větších rozměrů a efektivně uchopit takto rozsáhlou materii v několika stránkách je nadlidským úkolem. Zvolila jsem tedy následující rozčlenění kapitol. V kapitole první bych se ráda zaměřila na historický vývoj a migraci této menšiny společně s uvedením několika právních dokumentů postihující romské obyvatele. Díky tomuto krátkému exkursu bude pro čtenáře snadnější pochopit mentalitu a nynější styl romského života. V kapitole druhé jsem se pokusila uchytit a vysvětlit těžko uchopitelný pojem ?menšina? a její možné definice společně s tříděním. Kapitola třetí poukazuje na nejdůležitější mezinárodní dokumenty o lidských právech i na úpravu na našem území. Obě tyto kapitoly poslouží jako podklad pro následující stěžejní části. Kapitola čtvrtá nastíní právní uvažování Evropského soudu pro lidská práva v oblasti menšinových práv v rozsudku Natchova a ostatní vs. Bulharsko, jež se stal z velké části judikatorním východiskem a opěrným bodem soudu v rozsudku D. H. a ostatní vs. Česká republika. Tento rozsudek reflektoval problematiku umisťování romských dětí do zvláštních škol v Ostravě, kde žalujícími bylo několik rodin patřících k příslušníkům romské menšiny a dopad rozhodnutí měl nemalý vliv na legislativu i následující vývoj v oblastech terénní práce a celkového přístupu různých organizací k romským obyvatelům. Toto vše bych ráda rozebrala po skutkové i právní stránce v kapitole páté. Kapitola šestá pak poskytne přehled změn, které byla Česká republika na základě výsledku rozhodnutí Velkého senátu povinna provést. Můj zájem o lidská práva, speciálně práva menšin, jež jsou jejich důležitou výsečí, pramení z podstatné části z vlastních pracovních zkušeností. Přes pět let jsem se denně stýkala s romskými obyvateli, navštěvovala semináře týkající se romské otázky a společně s kolegy jsme dosáhli několika úspěchů v grantových řízeních. Proto bych své poznatky z praxe ráda využila a práci o ně obohatila.

Abstract:

The keynote of this graduation theses was to outline the problems faced by the Roma minority in the Czech Republic. Specifically, in the field of education within in the Ostrava region. The main intent was to familiarise the reader with the history of the Roma minority, through a brief excursion on the issue. Wherein, I had deemed it essential in order to develop a better comprehension, of their thinking and behaviour, whilst simultaneously creating a general view of the majorities within society impacting upon the Roma minority. The reader would come to know about the arrival of Roma people to Europe; their existence and conflict during the second world war; and the changes in their life after the Velvet revolution, which became a watershed for the completion of the overall image the Roma people The task of the two following chapters was to clarify the concepts which relate to the protection of their Human Rights and development , as well as the specification of various criteria. All of which, are necessary for an individual to be able to subordinate to the particularly accepted minority group. In this regard, this makes it possible to require special legal protection guaranteed by such regulations, on both the international and national level. Readers obtained a list of the substantial documents with an emphasis placed on any provisions in which, the protection of minority groups had been incorporated . The effort was, in those areas, to devote specified attention to the pitfalls of these chapters, and to highlight and describe the various provisions, which were crucial in the implementation of the protection of minority rights. By dint of the extract from the jurisprudence of the European Court of Human Rights in the case Natschova. and others v. Bulgaria, the reader could fill in information about the violation of fundamental rights. The state of the facts and legal analysis of this case lightly outlined the emerging interest in human rights and serve readers as a particular foundation for comparison in future judicial decision, within a similar area. Definitely, this is an interesting example, in the light of the persuasiveness and strength of the indirect evidence in accordance with any discriminatory conduct. The final two, crucial, chapters closely specify to the reader the circumstances of the case D. H. and remain vs. the Czech Republic, and of its subsequent impact on the Government of the Czech Republic. The actual case points out the different opinions of "ordinary" and the great Senate , presents a consideration of potential misconduct in the assessment, during the administrative procedure, of the plaintiff and various organisations dealing with the Roma issue. Not least, the object of this work was to summarise the impact of the consequences of a final decision, in which the the breach of the domestic law, specifically, Article 14, in relation to Article 2 of Protocol No. 1 of the Convention, was granted to claimants at the rate of 13:4. The reader will obtain a brief overview of the rule of law, which was necessary to regulate, in the order that, their current provisions fulfil the remedial requirements of the judgement. At the same time, the reader is given a practical application example, where the task of working with Roma institutions whose activities provide access to education, the integration process and the world of work. I believe that the objectives of my work were accomplished. The unstable and explicit view of the whole issue was presented though from the historic overview up until the actual provisions regarding The Human Rights . The Selected case law with the legal analysis and having the result of putting that decision into practice, outlined to readers, the pending questions in regards to the treatment of the Roma minority. This work gave me a deeper knowledge into the theory and it became a valuable experience in regards to my current work in the field of Roma education.
