The Comparison of Different Possibilities of Divorce in the Czech Republic

Abstract:

Cílem mé bakalářské práce bylo zpracovat téma související se současnou právní úpravou rozvodu manželství v ČR se zaměřením se na detailní popis rozdílů mezi rozvodem sporným a nesporným. První část, zakládající se na analýze odborné literatury, představuje historický vývoj této problematiky v českých zemích a ve významných společenských kulturách ve světě. Další bod vymezuje vybrané pojmy a definuje základní subjekty včetně jejich postavení v rámci obou alternativ rozvodu. Hlavní část práce prezentuje nepřímou komplexní komparaci obou způsobů rozvodu, věnuje se zejména rozdílům v jejich právní úpravě, dále specifikuje jejich podmínky i průběh a uvádí exaktní řešení jejich právních následků. Poslední část práce obsahuje zpracování výsledků šetření týkajícího se sledované problematiky na reprezentativním vzorku respondentů.

Abstract:

The aim of my bachelor´s thesis was to adapt the topic which relates to contemporary legal regulations of the ending of marital union in the Czech Republic and to focus on the particularised description of differences between contested and uncontested divorces. The first part is based on the analisys of professional literature and it presents historical development of this issue in Czech countries as well as in important social cultures in the world. The next point defines chosen terms and gives a definition of basic entities including their positions during both possibilities of divorce. The main part of this thesis presents indirectly the comparison of both ways of divorce, it deals with the diffirences in their legal regulations, it specialises their conditions as well as the process and it introduces the exact solutions ot the legal consequences. The last part contains the processing of the results of the survey which is connected with followed issue on the representative sample of respondents.
