Abstract:
Rigorózní práce se zabývá řízením o nahrazení souhlasu s vydáním úschovy. Rozebírá podrobně relevantní právní úpravu a judikaturu a sbírá poznatky ze skutečných případů těchto žalob, které se objevily v soudní praxi. Je provedena komparace české a slovenské právní úpravy se zaměřením na odlišnosti a benefity každé z úprav. Stručně je zmíněna též historie a srovnání s německou právní úpravou. Zjištěné …more

The rigorous thesis explores the procedure for replacement of consent to the issuance of a court deposit. It analyzes relevant legislation and case law in detail and gathers insights from real cases of these lawsuits that have appeared in court practice.
