The purchase contract in accordance with the civil code

Abstract:

This bachelor´s work deals with determination of the purchase contract institute in term of contemporary legal regulation in accordance with the Civil Code. The work has been focused above all to analysis of individual contentual components of the term purchase contract as well as to detailed analysis of all legal relations which are applied within the framework of the purchase contract as the legal institute. In this work there is particularly modified especially origination, content, discharge and protection within the scope of the purchase contract as the parts of the complex of the most important privale legal relations. The seriousness and importance of this subject in light of legal regulation is set by solitary understanding of the purchase contract as the private legal institute which is the integral part of the complex of the legal rights. The bachelor´s work consists of introduction, three chapters and conclusion. The introduction contains the question of the purchase contract and introduces the target of this work. The first chapter deals with the regulation of the purchase contract as the institute of the civil law and its position int the legal system, it also gives the analysis of the general contractual relations and types of the purchase contract. The second chapter deals with the purchase contract in general in sequence to its subjects, its substantial and secondary requirements where is also mentioned the right of repurchase. The third chapter is aimed at responsibility relations, kinds of responsibility in purchase contract, defects and compensation of loss in case of purchase contract. The final part contains the summarization of the bachelor´s work, recapitulation of abtained knowledge and its evaluation.

Abstract:

Predmetom tejto bakalárskej práce je vymedzenie inštitútu kúpnej zmluvy z hľadiska súčasnej právnej úpravy podľa Občianskeho zákonníka. Práca sa zameriava predovšetkým na podrobný rozbor jednotlivých základných obsahových súčastí pojmu kúpna zmluva, ako aj podrobnú analýzu všetkých právnych vzťahov, ktoré sa uplatňujú v rámci kúpnej zmluvy ako právneho inštitútu. V tejto práci je podrobne upravený predovšetkým vznik, obsah, zánik a ochrana v rámci kúpnej zmluvy, ako súčasti komplexu najdôležitejších súkromnoprávnych vzťahov. Vážnosť a dôležitosť tejto témy z hľadiska právnej úpravy je daná samotným ponímaním kúpnej zmluvy, ako súkromno-právneho inštitútu, ktorý je neoddeliteľnou súčasťou komplexu majetkových práv. Bakalárska práca sa skladá z úvodu, troch kapitol a záveru. V úvode predostieram otázku kúpnej zmluvy a zadávam cieľ tejto práce. V prvej kapitole sa zaoberám úpravou kúpnej zmluvy ako inštitútu občianskeho práva a jej postavenie a miesto v právnom systéme, rozoberám všeobecne záväzkové vzťahy a druhy kúpnej zmluvy. V druhej kapitole rozoberám kúpnu zmluvu všeobecne v nadväznosti na jej subjekty, jej podstatné a nepodstatné náležitosti, kde som rozobral aj právo spätnej kúpy. V tretej kapitole som sa zameral na zodpovednostné vzťahy, na druhy zodpovednosti pri kúpnej zmluve, na vady a na náhradu škody pri kúpnej zmluve. V závere som zosumarizoval bakalársku prácu, zhrnul získané poznatky a zhodnotil ich.
