Distraint by Selling Movable Assets
Abstract:
Diplomová práce se zabývá jednotlivými fázemi exekuce prodejem movitých věcí. Cílem práce je provést kritickou analýzu problematických oblastí tohoto způsobu provedení exekuce. Pozornost je věnována rozboru problematiky věcí, jež nemohou být pojaty do soupisu. Práce se věnuje také možnosti obrany třetích osob, zejména návrhu na vyškrtnutí věci ze soupisu a vylučovací žalobě a vztahu mezi nimi.
Abstract:
This thesis deals with the phases of the distraint by selling movable assets. The aim of this thesis is to carry out a critical analysis of the problematic areas of this execution process. Attention is paid to the analysis of the problems of things that cannot be conceived in the inventory of property.
