Import and Export from the point of view of taxes and customs duties

Abstract:

Mezinárodní obchod je jedním z nejviditelnějších projevů globalizace, a s výjimkou dvou let nedávné krize si udržuje dlouhodobý růstový trend. V některých případech se objem vrátil na předkrizovou úroveň. Dovoz a vývoz zboží, myšleno fyzických statků, patří do mezinárodního obchodu jako jeho nejdůležitější součást. Jako ostatně každá ekonomická činnost, i mezinárodní obchod podléhá určitému vlivu států, případně nadnárodních institucí. Nejzřetelněji se tento vliv projevuje právě v oblasti daní a cel, které obvykle vyjadřují obchodní politiku státu či nadnárodních institucí. Česká republika jako člen Evropské unie nemá vlastní celní politiku, ta je společná a jednotná pro všechny členské státy a ČR jí může pouze ovlivňovat, sama ji nevytváří, avšak do jisté míry z ní i profituje. V daňové oblasti je i přes evropské předpisy, zejména směrnice, jejichž zásady musí členské státy implementovat, dána národním státům určitá míra autonomie. Daně a cla jsou poměrně velmi sofistikovanou oblastí, kde se střetávají jak zájmy zahraniční politiky a míry vlivu ve světě, tak také parciální zájmy jednotlivých subjektů či silných nadnárodních firem případně podnikatelských uskupení, tak také zájmy osob, které provozují nekalé obchodní praktiky či přímo trestnou činnost. Jednotliví hráči uplatňují jak zvýhodnění pro vlastní výrobce či obchodníky, tak také opatření ochranářského typu vůči konkurenci z jiných států. Oblast daní a cel prochází i nadále určitým vývojem a také v budoucnu se očekávají určité změny a zdá se, že přes určité proklamace nebude nikdy dosaženo stavu úplné liberalizace zahraničního obchodu, k níž by vedla cesta právě přes omezení či zrušení fiskálních a nefiskálních překážek zahraničního obchodu. Všemi těmito aspekty se zabývá předkládaná práce.

Abstract:

International trade is one of the most visible demonstrations of the globalization and, with the exception of the two years of the recent crisis, it shows continuing trend of growing. In some cases the volume of international trade has decreased to the level existing before the beginning of the crisis. The import and export of goods, i.e. material estates, is the most important part of international trade. Like any economical activity also international trade is subject to the influence of states or possibly international institutions. This influence is most apparent in particular in the area of taxes and customs duties, reflecting usually the trade policy of states of international institutions. The Czech Republic, as a member of the European Union, does not have its own customs policy; this policy is common to all member states. The Czech Republic can only influence the customs policy, it does not define it on its own, but it benefits from the policy to some extent. As for the tax area, the member states have a certain level of autonomy, even though there are EU legal instruments, especially directives, setting principles which the member states must implement. Taxes and customs duties represent quite a sophisticated area where the interests of foreign policy and international influence of states meet with partial interests of individual subjects, strong supranational companies or trade associations and also interests of persons involved in illegal trade or even criminal trade activities. The individual players seek advantages for their traders and producers or protection from the competition coming from third states. The area of taxes and customs duties is constantly developing and certain changes are expected also in the future. It seems that, in spite of some proclamations, the foreign trade will never be fully liberalized by means of elimination of fiscal and non-fiscal trade barriers. The presented thesis deals with all above mentioned aspects.
