Sanctions in Law (with Respekt to the Issues of an Extraordinary Punishment)

Abstract:

Tato diplomová práce je zaměřena na sankce v právu. Se sankcemi úzce souvisí právní normy, které jsou na začátku práce obecně rozebrány a zaměřil jsem se především na leges imperfectae. Druhá část práce je zaměřena na samotné sankce. Zabýval jsem se především trestními sankcemi, u kterých jsem se zaměřil na jednotlivé druhy trestů dle účinného trestního zákoníku a snažil jsem se poukázat na nedostatky právní úpravy, jejich dopady na pachatele a navrhnout možná řešení. U těchto trestů jsem se více zaměřil na výjimečný trest a úvahu o trestu smrti- zda ho zavést, či ne.

Abstract:

This diploma thesis concentrates on sanctions in law. The sanctions are closely related to legal norms, that are generally analysed in the first part of the diploma thesis, and I focused mostly on leges imperfectae. The second part deals with the sanctions themselves. I paid attention mostly to punitive sanctions within which I concentrated on the individual kinds of punishments under the effective penal code and I tried to point out the deficiencies of the legal regulation, their impact on the offender and to propose possible solutions. In connection with these punishments I paid special attention to exceptional sentence and thoughts about death penalty – if it should or should not be introduced.
