Administration of ecological taxes by the Customs Authority of the Czech Republic pursuant to Act No. 261/2007 Coll., effective as of 1 January 2008

Abstract:

Bakalářská práce je věnována třem novým daním - dani ze zemního plynu a některých dalších plynů, dani z pevných paliv a dani z elektřiny, které byly zavedeny do českého daňového systému od 1. ledna 2008, kdy se stal účinným zákon č. 261/2007 Sb., o stabilizaci veřejných rozpočtů. Úvod práce je věnován historii zdanění, vývoji daní, funkcím daní, konstrukci daní a současnému českému daňovému systému. V druhé části práce jsou rozebrány důvody, pro které byly ekologické daně zavedeny a právní předpisy, na základě kterých vstoupily ekologické daně v platnost. Třetí část se již věnuje samotným ekologickým daním, zejména předmětům daní, plátcům daní, sazbám daní a podmínkách, za kterých je možné předměty daní od daně osvobodit. V závěrečné, čtvrté části se rozebírají činnosti správce daně, které musí při správě daní vykonávat a věcné a právní problémy, které jsou se správou ekologických daní spojeny a které správce daně při své činnosti v prvním roce existence ekologických daní musel řešit.

Abstract:

The bachelor thesis addresses the problem area of three new taxes. These comprise the tax on natural gas a some other gases, the solid fuels tax, and electricity tax that were introduced into the Czech tax system on 1 January 2008 with Act. No. 261/2007 Coll., (Public Finance Stabilisation Act) becoming valid and effective. The opening chapter deals with the history of taxation, trends and functions of respective taxes, the construction of taxes, as well as with the current Czech tax system. Chapter Two of the thesis features an analysis of causes lying behind the imposition of ecological taxes, and a set of legal regulations serving as a basis for the said ecological taxes to enter into force. Chapter Three of the thesis is devoted to the respective ecological taxes, particularly to tax objects, tax payers, tax rates, and to terms and conditions under which tax objects are possible to become exempt from tax liability. In the concluding Chapter Four of the thesis, activities of the tax authority are dissected, meaning activities that have to be pursued as part of tax administration, including matter-of-fact and legal issues associated with the administration of ecological taxes, and activities that the tax authority was supposed to - in pursuance of his activities - tackle throughout the first year of the ecological taxes being in place.
