Forensic Aspects Of The Protection Of Endangered Species Under CITES

Abstract:

Bakalářská práce je zaměřena na problematiku mezinárodního obchodu s ohroženými druhy volně žijících živočichů a planě rostoucích rostlin. Jejím cílem je vypracování základů metodického postupu, který stanoví postup kriminalistů při vyšetřování trestné činnosti, kterou byly porušeny předpisy stanovené Úmluvou o mezinárodním obchodu ohroženými druhy volně žijících živočichů a planě rostoucích rostlin a dalšími platnými právními předpisy. Bakalářská práce popisuje předmět této kriminální činnosti, jaké živočichy a rostliny Úmluva chrání, dále charakterizuje vlastnosti pachatelů a jejich motivy k páchání trestné činnosti související s ohroženými druhy. V bakalářské práci je také popsán způsob, jakým pachatelé ohrožené druhy přepravují, jak zakrývají stopy své nelegální činnosti a postup kontrolních orgánů při odhalování této kriminální situace. Praktická část bakalářské práce je zaměřena na dotazníkové šetření, jehož cílem bylo zmapovat všeobecné povědomí o dané problematice, jak v rámci kontrolních orgánů, tak ve společnosti obecně. Zjištění je možné využít ke zdokonalení kontroly a předcházení trestné činnosti související s ohroženými druhy.

Abstract:

The bachelor thesis is focused on the issue of international trade in endangered species of wild fauna and flora. Its aim is to elaborate the foundations of the methodological procedure which sets out the procedure of criminalists in the investigation of crime that violated the provisions of the Convention on International Trade in Endangered Species of Wild Fauna and Flora and other applicable legislation. The bachelor thesis describes the subject of this criminal activity, what animals and plants the Convention protects, further characterizes the characteristics of offenders and their motives to commit crimes related to endangered species. The bachelor thesis also describes the way in which perpetrators transport endangered species, how they hide traces of their illegal activities and the procedure of control bodies in detecting this criminal situation. The practical part of the thesis is focused on the questionnaire survey whose aim was to map general awareness of the issue, both within the control organs and in society in general. The findings can be used to improve the control and prevention of crimes related to endangered species.
