Easements within New Civil Code

Abstract:

Tato bakalářská práce postihuje problematiku věcných břemen v novém občanském zákoníku. Věcná břemena jsou v nové právní úpravě opět rozdělena na služebnosti a reálná břemena. Tímto se vrací pojetí věcných břemen k římským kořenům a kořenům českého práva platných do padesátých let, což v první části práce shrnuje nahlédnutí do historického významu věcných břemen. Záměrem této práce je kritická analýza nové právní úpravy včetně porovnání s právní úpravou předchozí, to vše se zřetelem na závažnou judikaturu, která je cíleně několikrát citována.

Abstract:

This work affects the issue of easements in the new Civil Code. Easements are in the new legislation again divided into servitudes and real burdens. This returns the concept of easements to the Roman roots and the roots of Czech law in force during the fifties, which is in the first part of the paper summarized by an insight into the historical significance of easements. The aim of this work is a critical analysis of the new legislation, including a comparison with previous legislation and accounting the major case law which is specifically cited several times.
