Criminal Liability of the Legal Persons

Abstract:

Kořeny trestní odpovědnosti právnických osob můžeme nalézt v anglosaském právním systému 19. století. S rozmachem globálního pojetí hospodářství bylo nezbytné začlenit tento institut i do kontinentálního práva, ke kterému český právní systém po právu náleží. Právní úprava trestní odpovědnosti právnických osob je v našich podmínkách platná již čtvrtým rokem. Srovnání české právní úpravy trestní odpovědnosti právnických osob s okolními státy odkrývá rozdílné přístupy a nedostatky v této problematice v rámci Evropské unie v kontrastu s jednotným evropským trhem, potažmo jednotným hospodářským prostředím. Další nedostatky vystupují na povrch při hlubším zkoumání, zejména v aplikační praxi, které jsou následně zákonodárcem odstraňovány dílčími novelami.

Abstract:

The roots of corporate criminal liability of legal persons can be found in the Anglo-Saxon legal system of the 19th century. With the expansion of the global economy, it became necessary to incorporate this concept of corporate criminal liability for legal persons into continental law, in which the Czech legal system belongs. Legislation providing for corporate criminal liability has been in effect in the Czech Republic for four years. A comparison of the Czech corporate criminal liability legislation with the corporate criminal liability legislation of neighboring countries reveals different approaches and certain deficiencies in this area within the European Union, in contrast to the concept of a unified European market and economic environment. Other deficiencies arise upon closer examination, especially in the application of the legal practice, which deficiencies are subsequently addressed by the legislature under piecemeal amendments.
