Objection of limitation

Abstract:

Diplomová práce se zabývá v první části samotným promlčením, když vymezuje jeho pojem, podstatu a účel úpravy v občanském zákoníku. Podává rovněž výklad o historických souvislostech, předmětu promlčení a promlčecí lhůtě. V druhé části je popsána námitka promlčení jako obrana dlužníka proti promlčenému právu, které je věřitelem uplatňováno před soudem. Práce podává komparaci názorů na spornou povahu námitky promlčení, poukazuje na to, jaký subjekt může promlčení namítnout a vůči komu tak činí. V závěru autorka nahlíží na specifické pojetí promlčení v anglickém právu.

Abstract:

The first part of the thesis deals with the statute of limitations itself, defining its concept, essence and purpose of its regulation in the Civil Code. It also provides an explanation of the historical context, the subject of limitation and the limitation period. The second part describes objection of limitation as a defence by the debtor against a time-barred right which is asserted by the creditor before the court. The thesis provides a comparison of views on the disputed nature of the statute of limitations objection, points out which subject may object to the statute of limitations and against whom. Finally, the author looks at the specific concept of limitation in English law.
