Předmětem této rigorózní práce jsou zastřené pracovněprávní vztahy, veřejnosti spíše známé pod označením „švarcsystém“. Jde o způsob nelegálního zaměstnávání, kdy zaměstnavatel předstírá, že má se svým zaměstnancem vztah dvou osob samostatně výdělečně činných, zatímco zastírá skutečný stav, tedy výkon závislé práce, který je přípustný zásadně jen v základním pracovněprávním vztahu, jinak se jedná o …more

Disguised employment relationships are the subject of this thesis. It is commonly known to the public as so called "švarcsystém". It is a way of illegal employment in which an employer pretends to have a relationship with his employee as if they were self-employed persons while disguising the true state, i.e. performance of dependent work, which is allowed only in a standard employment relationship …more
