Position of the Weaker Party in Private International Law on the Example of a Consumer Contract

Abstract:

Diplomová práce je zaměřena na analýzu spotřebitelské smlouvy z pozice slabší strany v normách mezinárodního práva soukromého. Primárním cílem práce je analýza spotřebitelské smlouvy při vzájemném provázání kolizní i procesní úpravy. Nejdříve se práce věnuje základním pojmům, které výrazně dotvořila judikatura SDEU. Dále je rovněž představeno uchopení samotné spotřebitelské smlouvy, a to s ohledem na jednotlivé typy obchodů. Následně je prostor věnován otázkám rozhodného práva a příslušnosti soudů. Závěrem je provedena interakce kolizní i procesní úpravy, společně s možnými změnami právní úpravy.

Abstract:

The thesis focuses on the analysis of the consumer contract from the position of the weaker party in the norms of private international law. The primary objective of the thesis is to analyse the consumer contract in the interrelation of conflict of laws and procedural rules. First, the thesis deals with the basic concepts, which have been significantly shaped by the case law of the CJEU. Next, the grasp of the consumer contract itself is also presented, with respect to the different types of transactions. Subsequently, space is devoted to the issues of applicable law and the jurisdiction of the courts. Finally, the interaction of conflict of laws and procedural rules is examined, together with possible changes to the legislation.
