Current Account Contract and Direkt Banking

Abstract:

Základním cílem této bakalářské práce bylo vystihnout podstatné okolnosti a podmínky pozitivně-právní úpravy smlouvy o běžném účtu a provést rozbor obchodních podmínek používaných bankami jak z pohledu banky, tak i z pohledu klienta - majitele účtu. Rozbor problematiky smlouvy o běžném účtu je postupně řešen od samotného terminologického zakotvení souvisejících pojmů, přes rozbor historicko-právního rámce tohoto typu smlouvy až k samotnému rozboru obsahu smlouvy o běžném účtu. Současně byl v této práci proveden rozbor specifických rysů obchodních podmínek obecně a také jejich konkrétní aplikaci v podobě bchodních podmínek dvou největších českých bank (ČS a.s., ČSOB a.s.). Prostor byl ve značné míře věnován i klientskému pohledu na jednotlivé body obchodních podmínek i obecným otázkám klientského přístupu bank. Tato kapitola se věnovala i spolupráci bank se státními orgány - ve smyslu stabilizace a realizace požadavků veřejnosti v oblasti kvality a parametrů poskytování bankovních služeb. Mezi druhou stěžejní oblast zájmu této bakalářské práce patřila problematika přímého bankovnictví, včetně forem elektronického bankovnictví. Elektronické bankovnictví zahrnuje řadu rozsáhlých forem a s nimi spojených technologií, jejichž podstatu jsem se pokusila v práci vystihnout. Základní nabízené služby jsou internetbanking, homebanking, phonebanking, GSM banking a WAP banking, které jsou veřejností v rozmanité míře využívány a jejichž způsobem využití a výhodami se tato bakalářská práce v nemalé míře zabývá. Každá s forem elektronického bankovnictví vyžaduje specifické potvrzení o autorizaci ze strany majitele účtu a právě těmito bezpečnostními opatřeními se zabývá podstatná část kapitoly o přímém bankovnictví.

Abstract:

The primary objective of this thesis is to summarise all relevant conditions and circumstances of the positivist law codification of current account contracts and to analyse the terms and conditions used by banks. This is to be conducted from the perspective of a bank as well as from the perspective of a client - the account holder. The area of current accounts covered by this thesis includes specific terminology, analysis of the legal and historical framework of this type of contract and an analysis of the contract itself. The paper also analyses specific features of the terms and conditions both generally and in their practical applications by the two largest Czech banks (CS a. s., CSOB a. s.). Particular focus is paid to the client's perspective of the individual terms and conditions and banks' approach to their clients in general is discussed. This chapter also covers the area of banks' cooperation with state administration - in terms of stabilization and the implementation of public interest in quality and conditions of bank services. The second main area that this thesis addresses is direct banking, including various kinds of electronic banking. Specific focus is given to direct banking as the development in services offered in the electronic banking sector is very topical and progressive. The thesis, therefore, must be be viewed in the context of a given space and time (i. e. March 2006, Czech Republic). The thesis concludes, among other things, that the current rising interest in direct banking services is influenced by the overall rise in the numbers of new current and debit accounts that require convenient 24/7 access. Remote access and on-line banking are amongst the most widely used electronic data comminication services. Electronic banking consists of a number of different forms and related technologies; the basis of these is outlined. Primary services include internetbanking, homebanking, phonebanking, GSM banking and WAP banking. The thesis looks at how these services are used by the public. Specific advantages and usage patterns are therefore discussed in this thesis. I have attempted, in this work, to outline and, to a certain degree compare, direct banking products and applications of selected Czech banks. In order to best use my resources, I decided to focus on the two czech banks with the highest number of clients, which thus have a range of direct banking options in their product portfolios. These banks are Ceska sporitelna a. s. and CSOB a. s. The final chapter addressed the set-up and running costs, not only in the financial sense but also concerning time-saving and convenience. The development of electronic banking is one of the driving forces behind technological development, especially with regards to security systems. The protection of communication content is tackled in the final section with the aim of outlining primary principles of account security and the security of transactions carried out by the account holder. Each of the electronic banking services uses a specific method for the authentication of the account holder. These security methods constitute the basis of the final chapter.
