Reforma autorského práva EU: Autorské právo ve Směrnici o jednotném digitálním trhu. Cíle, důvody a dopady na dotčené subjekty

Abstract:

Tato práce zkoumá, jak je dosaženo rovnováhy mezi protichůdnými zájmy ochrany autorských práv a šíření děl v evropské Směrnici o autorském právu na jednotném digitálním trhu (JDT), která aktualizuje právní úpravu autorského práva s ohledem na výzvy digitálního prostředí. Cílem práce je zhodnotit důsledky směrnice pro dotčené subjekty a nositele práv a vyvodit relativní slabiny a silné stránky jejího hlavního vyvažovacího systému, tzv. systému výjimek a omezení autorského práva, a to na základě srovnání s americkou Fair Use Policy. Práce se skládá ze tří hlavních kapitol. První z nich představuje debatu o ekonomických motivech a důvodech existence duševního vlastnictví a představuje přístup k autorskému právu, který se odráží ve směrnici o autorském právu na JDT. Druhá kapitola se zaměřuje na nejkontroverznější novinky a analyzuje jednak jejich ekonomické důsledky pro dotčené subjekty a jednak způsob, jakým je v jednotlivých případech dosahováno rovnováhy mezi ochranou autorských práv a šířením chráněných předmětů. Třetí kapitola začíná teoreticko-ekonomickým srovnáním evropského a amerického systému autorského práva. Poté se zaměřuje na rozdíly mezi systémem výjimek a omezení autorského práva v EU a odpovídajícím systémem Fair Use Policy v USA s cílem zdůraznit silné a slabé stránky prvního z nich, se zvláštním důrazem na rozdílné dopady obou doktrín na dotčené subjekty.

Abstract:

This thesis examines how the equilibrium between the opposing interests of copyright protection and dissemination of works is reached in the EU Directive on Copyright in the Digital Single Market (DSM) that updates copyright rules to the digital environment. It aims at evaluating the outcomes of the Directive on the stakeholders involved and at deducing relative weaknesses and strengths of its main balancing system, the exceptions and limitations to copyright, by comparing it to the American Fair Use Policy. The work consists of three main chapters. The first one presents the debate on the economic motivations and justifications for the existence of Intellectual Property and examines the approach to copyright reflected in the DSM Directive. The second chapter is focused on the most controversial novelties, analyzing both their economic consequences for stakeholders and how the balance between copyright protection and access to works is reached in each of the cases. The third chapter begins with a theoretic-economic comparison of the European and American copyright systems. Then, it continues by focusing on the differences between the EU system of exceptions and limitations to copyright – as modified by the DSM Directive – and the corresponding USA’s Fair Use Policy, aiming at underlining strengths and weaknesses of the former, with special focus on different impacts of the two doctrines on affected stakeholders.
