Changes in Building Act before and after 1. 1. 2013

Abstract:

Stavební právo v České republice řídí zákon č. 183/2006 Sb., o územním plánování a stavebním řádu, který upravuje cíle, úkoly a postupy na úseku územního plánování a stavebního úřadu. Tématem předkládané diplomové práce jsou změny ve stavebním řádu před a po 01.01.2013, kdy byl zákon č. 183/2006 Sb., o územním plánování a stavebním řádu, novelizován zákonem č. 350/2012 Sb., s účinností od 01.01.2013. Sledovaným cílem práce bylo na základě empirických zkušeností a vzájemné komparace předchozí a současné právní úpravy, tzn. před a po novele zákonem č. 350/2012 Sb., postihnout zásadní legislativní změny v postupech nejčastějších institutů územního plánování a stavebního řádu, mezi které v první řadě patří povolování staveb jako primární a nejčastější činnosti stavebních úřadů. V jednotlivých kapitolách práce jsou na úseku územního plánování a stavebního řádu uvedeny způsoby a jejich změny v povolování staveb spojené s novelou stavebního zákona, a to za použití zákona č. 350/2012 Sb., a dostupné správní judikatury. Práce traktuje věcná témata a na základě zjištěných skutečností ve svém závěru hodnotí přínos novely dotčených témat a současně doporučuje legislativní návrhy změny stavebního zákona č. 183/2006 Sb., o územním plánování a stavebním řádu, v platném znění, jako primárního předpisu vnitrostátního veřejného stavebního práva.

Abstract:

Planning and building laws of the Czech Republic are defined by the Building Act No.183/2006 Coll. on town and country planning and building code (Building Act) that governs, in the matters of town and country planning, particularly the objectives and tasks of town and country planning and procedures within the town and country planning authorities. The theme of this dissertation is a range of changes in the building code before and after 1 January 2013 when the Building Act No.183/2006 Coll. on town and country planning and building code was amended by the Act No. 350/2012 Coll. that entered into effect on 1 January 2013. The target of this dissertation, based on empirical evidence and comparison of previous and current legal regulations, i.e. before and after the amendment by the Act No. 350/2012 Coll., was to cover significant legislative changes in the procedures of the most common institutions of town and country planning and building code, especially including the issuance of building permits as the most important and common activity of the building offices. Each chapter of this dissertation introduces, within the town and country planning authorities and the building code, the ways and their changes in building permission connected to the amendment of the Building Act using both the Act No.350/2012 Coll. and accessible administrative judicature. This dissertation deals with objective topics and, based on the discovered facts, concludes suggesting some legislative changes of the Building Act No.183/2006 Coll. on town and country planning and building code as amended, as the primary regulation of the domestic public planning and building laws.
