Subsidiarity of Criminal Repression

Anotácia:

Cílem diplomové práce je vymezit základní zásadu trestního práva hmotného subsidiaritu trestního postihu a vymezení úvah a doporučení „de lege ferenda“ z pohledu autora působícího v rámci aplikační praxe. V první kapitole jsou vymezeny historické aspekty vývoje subsidiarity trestní represe. Kapitola druhá pojednává o charakteristice subsidiarity trestní represe a vymezení základních pojmů, vztahu k dalším základním zásadám trestního práva hmotného, k principu „ultima ratio“ a pojetí trestného činu. V rámci třetí kapitoly je zásada subsidiarity trestního postihu zasazena do normativního systému a následně je popsáno zakotvení této zásady a její faktické projevy v novém trestním zákoníku s vymezením procesních souvislostí. Následně jsou ve čtvrté kapitole vymezeny procesní nástroje k aplikaci zásady subsidiarity trestního postihu, její aplikace v praxi (orgány činnými v trestním řízení a obhajobou) a je popsána judikatura Ústavního soudu a soudů obecných. Kapitola pátá tematizuje souvislost zásady trestního postihu s právem občanským a správním a v kapitole šesté jsou vymezeny vybrané zahraniční přístupy, jakožto doplňující poohlédnutí. V poslední kapitole je pojednáváno o problémech a nejasnostech, které v souvislosti se zakotvením této zásady a její aplikací vyvstaly a vyvstávají, s pokusem o vymezení úvah „de lege ferenda“.

Abstract:

The aim of this thesis is to define the basic tenet of criminal law subsidiarity of criminal repression and to define the “de lege ferenda” considerations and recommendations within the application practice. The first chapter defines the historical aspects of the development of the subsidiarity of criminal repression. The second chapter deals with the characteristics of the subsidiarity of the criminal repression and the definition of the basic concepts, the relationship with the other fundamental principles of the substantive criminal law, the ultima ratio and the concept of the crime. Within the third chapter, the subsidiarity of criminal repression is embedded in the normative system and annotation of this principle and its factual manifestations in the new Criminal Code with the definition of procedural contexts is described. Subsequently, the fourth chapter defines procedural tools for the application of the principle of subsidiarity of criminal repression, their application in practice and the case law of the Constitutional Court and the General Courts. Chapter 5 deals with the link between the subsidiarity of criminal repression and civil and administrative law, and sixth chapter defines selected foreign approaches as a complementary insight. The last chapter discusses the problems and ambiguities that arise and arise in connection with the anchoring of this principle and its applications, with an attempt to define considerations "de lege ferenda".
