Abstract:

V bakalářské práci Probační a mediační služba. Její současná podoba a úvahy, de lega ferenda, ve vztahu k trestnímu řízení popisuji chod této instituce v České republice. V mé práci popisuji stručně historii a vznik Probační a mediační služby ČR. Nejdůležitější částí bakalářské práce je popis právní úpravy Probační a mediační služby z hlediska trestního práva hmotného a procesního. Zabývám se obecně zákonem č. 257/2000 Sb. S tímto je úzce spojen pojem restorativní justice. Další částí práce hlouběji rozebírám významu probace a mediace a její činnosti. Popisuji, jakou činnost vykazuje Probační a mediační služba nebo například, co je to probační dohled. V neposlední řadě v bakalářské práci popisuji, jak je Probační a mediační služba zapojena do alternativních trestů, jako je například domácí vězení nebo obecně prospěšné práce. Cílem této práce bylo zhodnotit současnou činnosti Probační a mediační služby a navrhnout její změny do budoucna. Například její rozšíření nebo odtržení od dalších institucí. Pro praktickou část jsem využila dotazníkové šetření. Pomocí těchto dotazníků jsem chtěla zjistit, jaké alternativní tresty se nejvíce ukládají nebo jak dlouho trvá schůzka s probačním úředníkem.

Abstract:

In the bachelor thesis Probation and mediation services. Its current form and considerations de lega ferenda, in relation to prosecution, it is describe the functioning of the institution in Czech Republic. In my thesis I brifely describe the history and origin of Probation and Mediation services Czech republic to 1989. The most important part of the thesis is descriptions of the legislation Probation and Mediation Service in terms of criminal law and criminal procedure. I deal with Law no. 257/2000 Sb. With This law is connect notion of restorative jutice. In another part of thesis is analysed sygnificance and activities of Probation and Mediation. Also I descibe activities Probation and mediation Service in Czech repiblic, for instance, chat is the Probation Supervision. Last but not least,the bachelor thesis descibes how The Probation and Mediation Service is involved in alternative punishment, for example the house arrest or community services. The aim of this thesis was to evaluate the current activites Probation and Mediation Service and propose future ganges. For the practical part I used to questionnaire, with which help I wanted to find out what alternative punishment are given the most, or how long the meeting to with probation officer takes.
